Human Rights Due Diligence and the Issue of Conflict Minerals

År 2011 kom det första auktoritära ”soft law” dokumentet inom området företag och mänskliga rättigheter,”UN Guiding Principles on Business and Human rights”. I detta dokument åläggs företag ett ansvar att respektera mänskliga rättigheter genom att använda sig av en s.k."human rights due diligence" (HR DD). Denna ska bl.a. innehålla en "root cause analysis" för att överensstämma med det ansvar företag har för att respektera mänskliga rättigheter som fastslås i dokumentet. År 2011 kom det första auktoritära ”soft law” dokumentet inom området företag och mänskliga rättigheter,”UN Guiding Principles on Business and Human rights”. I detta dokument åläggs företag ett ansvar att respektera mänskliga rättigheter genom att använda sig av en s.k."human rights due diligence" (HR DD). Denna ska bl.a. innehålla en "root cause analysis" för att överensstämma med det ansvar företag har för att respektera mänskliga rättigheter som fastslås i dokumentet. Om HR DD inte används på det sätt som krävs för att företag ska respektera mänskliga rättigheter går syftet med att genomföra en HR DD förlorat. Av denna anledning måste företag se till att använda sig av en omfattande och rigorös metod, en ”root cause analysis”, som är en sorts analys av grundorsaken till problematiken.

Denna uppsats analyserar implementeringen av HR DD och om den inkluderar en metod såsom en “root cause analysis”. Fokus är främst de nuvarande relevanta rättsliga instrument rörande ”supply chains” av konfliktmineraler, såsom OECD Due Diligence Guidance for Responsible Supply Chains of Minerals from Conflict-Affected and High-Risk Areas, Dodd-Frank Wall Street Reform and Consumer Protection Act, section 1502 och ICT Sector Guide on Implementing the UN Guiding Principles on Business and Human Rights. Det är inom elektronik och informations- och kommunikations industrin som konfliktmineraler förekommer. Fokus kommer därför att ligga på dessa sektorer. Uppsatsen utvärderar även om dessa sektorer har uppmärksammat de särskilda drag som HR DD kräver.

Genom utredningen i uppsatsen kan konstateras att de lagar och dokument som varit föremål för utredning, i någon mån refererar till användandet av en ”root cause analysis” i deras HR DD. I vissa av fallen förekommmer det underförstått, men vissa stipulerar detta uttryckligen. Eftersom många företag använder och andra dokument refererar till OECD’s Due Diligence Guide inom området, rekomenderas att detta dokument uttrycker en tydligare referens till en ”root cause analysis” eller liknande och det konstateras även att vidare lagstiftining inom området är nödvändigt. Abstract
In 2011, the UN Guiding Principles (UNGPs) became the first authoritative international standard regarding the field of business and human rights. The document states a responsibility for companies to respect human rights. The operational principle of due diligence in the UNGPs is designed as a tool for companies to use in order to be able to respect human rights. However, if the due diligence is not conducted in a way that satisfies the responsibility to respect, the due diligence has lost its purpose and will not be able to help companies meet their goal as set out in the UNGPs. In order to conduct a due diligence, companies therefore need to make sure that they use a rigorous method such as a root cause analysis.

The document states a responsibility for companies to respect human rights. The operational principle of due diligence in the UNGPs is designed as a tool for companies to use in order to be able to respect human rights. However, if the due diligence is not conducted in a way that satisfies the responsibility to respect, the due diligence has lost its purpose and will not be able to help companies meet their goal as set out in the UNGPs. In order to conduct a due diligence, companies therefore need to make sure that they use a rigorous method such as a root cause analysis.

This thesis analyses the implementation of the concept of human right due diligence and whether or not it contains a root cause analysis. Focus are mainly the current relevant legal instruments regarding the supply chains of conflict minerals, such as the OECD Due Diligence Guidance for Responsible Supply Chains of Minerals from Conflict-Affected and High-Risk Areas, the Dodd-Frank Wall Street Reform and Consumer Protection Act, section 1502 and the ICT Sector Guide on Implementing the UN Guiding Principles on Business and Human Rights. Further, the Electronics and ICT sectors are chosen as a reserch objective since they are the largest consumers of conflict minerals. The theisis further investigate whether or not these sectors has acknowledged the unique fetures of conducting a human rights due diligence.

The theisis conclude that the instruments examined is in fact refering to rigorous metodologoies such as a root cause analysis in their human rights due diligence, yet in some cases subtly or implicitly and in other cases a direct reference is made. However, since most commonly used and other documents refer to the OECD Due Diligence Guidance, it is suggested that it would provide a clearer reference to rigorous metodologoies such as root cause analysis and that further legislative mesures are required in this area.
