Koppleri eller slaveri? Gränsdragningen mellan grovt koppleri och människohandel

Denna uppsats behandlar gränsdragningen mellan brotten grovt koppleri, 6 kap. 12 § brottsbalken, och människohandel, 4 kap. 1a § brottsbalken. Uppsatsens syfte är att undersöka och kritiskt granska var gränsen går mellan brotten samt att, utifrån ett brottsofferperspektiv, undersöka eventuella konsekvenser i anledning av gränsdragningen.

I uppsatsen undersöks grovt koppleri respektive människohandel utifrån brottens ursprung, rättsutveckling samt gällande rätt. Eftersom gränsdragningen mellan brotten inte har varit föremål för Högsta domstolens ställningstagande undersöks istället underrättspraxis. Därefter granskas, utifrån ett brottsofferperspektiv, brottens skyddsintresse samt frågor rörande målsäganderätt samt kränkningsersättning.... (More)
Denna uppsats behandlar gränsdragningen mellan brotten grovt koppleri, 6 kap. 12 § brottsbalken, och människohandel, 4 kap. 1a § brottsbalken. Uppsatsens syfte är att undersöka och kritiskt granska var gränsen går mellan brotten samt att, utifrån ett brottsofferperspektiv, undersöka eventuella konsekvenser i anledning av gränsdragningen.

I uppsatsen undersöks grovt koppleri respektive människohandel utifrån brottens ursprung, rättsutveckling samt gällande rätt. Eftersom gränsdragningen mellan brotten inte har varit föremål för Högsta domstolens ställningstagande undersöks istället underrättspraxis. Därefter granskas, utifrån ett brottsofferperspektiv, brottens skyddsintresse samt frågor rörande målsäganderätt samt kränkningsersättning.

Uppsatsen påvisar, trots uppenbara skillnader i fråga om brottens ursprung, syften samt omfattning, en gränsdragningsproblematik enligt gällande rätt. Kärnfrågan vid gränsdragningen är huruvida ett maktförhållande mellan gärningsperson och offer kan konstateras, samt om offrets fria och verkliga vilja har bemästrats. Vid domstolens ställningstagande ska en helhetsbedömning göras av omständigheterna i det enskilda fallet. Om kraven i kärnfrågan anses uppfylla ska gärningspersonen dömas för människohandel. Exempel på omständigheter som haft avgörande betydelse i rättspraxis är att offret saknat ekonomiska medel, inte behärskat svenska språket samt saknat egna kontakter i Sverige.

Genom uppsatsen framkommer vidare att gränsdragningen är särskilt betydelsefull utifrån ett brottsofferperspektiv. Anledningen är främst att frågor om skyddsintresse, målsäganderätt och kränkningsersättning avseende grovt koppleri visat sig vara förhållandevis problematiskt jämfört med människohandelsbrottet. Abstract
This thesis explores the demarcation between the crimes grave procuring, 6 ch. 12 § Penal Code, and human trafficking, 4 ch. 1a § Penal Code. The purpose of this thesis is to explore and critically examine the dividing line between the crimes, as well as, on the basis of victim’s perspective, examine consequences depending on which of the crimes that arise.

The examination of grave procuring and human trafficking is based on the crimes’ origin, law development and applicable law. Since the demarcation between the crimes has not been subjected to the Supreme Court's stance, rulings by courts adjucating under the Supreme Court has been examined. This thesis explores the demarcation between the crimes grave procuring, 6 ch. 12 § Penal Code, and human trafficking, 4 ch. 1a § Penal Code. The purpose of this thesis is to explore and critically examine the dividing line between the crimes, as well as, on the basis of victim’s perspective, examine consequences depending on which of the crimes that arise.

The examination of grave procuring and human trafficking is based on the crimes’ origin, law development and applicable law. Since the demarcation between the crimes has not been subjected to the Supreme Court's stance, rulings by courts adjucating under the Supreme Court has been examined. Then, through a victim's perspective, the crimes protection interests and issues regarding plaintiffs law and infringement compensation is explored.

The thesis demonstrates, despite obvious differences in terms of the crimes origin, purpose and scope, problems with interpreting and setting the demarcation between the crimes in current law. The core issue, in finding the dividing line between the crimes, consists of a requirement that a balance of power between perpetrator and victim is present, and that the free and true will of the victim is mastered. In the position taken by the court, the circumstances of the individual cases, must be assessed globally. If the requirements of the core issue is considered to be met, the offender shall be sentenced for human trafficking. Examples of circumstances that had a decisive impact in the case law is that the victim lacked financial means, did not mastered the Swedish language and lacked own contacts in Sweden.

The paper further reveals that the demarcation is particularly significant from a victim's perspective. The reason is that issues of protection interest, plaintiff law and infringement compensation regarding grave procuring is proved to be relatively problematic compared to human trafficking. (Less)
