Uppsatsen belyser bilmålvaktsproblematiken ur ett lagutvecklingsperspektiv. De frågor som ligger till grund för uppsatsen är: Vad är en bilmålvakt? Varför har det varit så svårt att finna en lösning på problemet med bilmålvakter? Har lagstiftaren efter lagändringarna kommit åt problemet och stoppat möjligheten för fortsatt bilmålvaktsverksamhet?

En bilmålvakt är en person som står som registrerad ägare av ett fordon i vägtrafikregistret, i stället för den som faktiskt äger och/eller brukar fordonet. Uppsatsen belyser bilmålvaktsproblematiken ur ett lagutvecklingsperspektiv. De frågor som ligger till grund för uppsatsen är: Vad är en bilmålvakt? Varför har det varit så svårt att finna en lösning på problemet med bilmålvakter? Har lagstiftaren efter lagändringarna kommit åt problemet och stoppat möjligheten för fortsatt bilmålvaktsverksamhet?

En bilmålvakt är en person som står som registrerad ägare av ett fordon i vägtrafikregistret, i stället för den som faktiskt äger och/eller brukar fordonet. Skatter och avgifter som är kopplade till ett bilägande går till den registrerade ägaren. Den registrerade ägaren betalar inte och har inte heller några utmätningsbara tillgångar. Syftet för en bilägare till att ha ett fordon registrerat på en bilmålvakt är att kunna undandra sig det ekonomiska ansvaret som följer av att inneha ett fordon. Problemet med bilmålvakter har växt fort de senaste tio åren, problemet var i stort sett okänt för 15 år sedan. Framförallt är problemet stort i Malmö.

Myndigheterna har på olika sätt försökt stoppa bilmålvaktsverksamhet. Bilar har omhändertagits och utmätts, bilmålvakter har dömts för bokföringsbrott och försatts i konkurs. Åtgärderna har inte stoppat bilmålvaktsverksamheten. Behovet av ny lagstiftning har varit uppenbart i flera år. Utredarna har behövt finna en lagkonstruktion som på ett effektivt sätt stoppar möjligheterna för fortsatt bilmålvaktsverksamhet, utan att drabba legitima upplägg. Ett stort problem för lagstiftaren har varit hur den nödvändiga inskränkningen i äganderätten ska konstrueras.

Lagändringarna innebär att fordonsskulder nu kopplas till fordonet. Myndigheterna kan nu omhänderta fordon som har minst 5000 kronor i skulder om det påträffas parkerat i strid med gällande föreskrifter. Om skulden inte betalas kommer fordonet att skrotas eller säljas. Ett överklagande med en äganderättsinvändning kan inte längre nå framgång då det, enligt den nya lagen inte spelar någon roll vem som äger fordonet.

Min slutsats är att de aktuella lagändringarna kommer att få önskad effekt. Flera tecken pekar redan på att så är fallet. Lagändringarna har emellertid ännu inte prövats i domstol. (Less)

This thesis highlights the problems with straw men for car ownership from a law development perspective. The questions that forms the base for the thesis are: What is a car straw man? Why has it been so difficult to find a solution to the problem with car straw men? Has the legislator through the legislative changes come to a solution concerning the problem and limited the possibility for continued car straw man activities?

This thesis highlights the problems with straw men for car ownership from a law development perspective. The questions that forms the base for the thesis are: What is a car straw man? Why has it been so difficult to find a solution to the problem with car straw men? Has the legislator through the legislative changes come to a solution concerning the problem and limited the possibility for continued car straw man activities?

A car straw man is a person who is the registered owner of a vehicle in the road traffic register, in place of the person who actually owns and/or uses the vehicle. Taxes and fees that are linked to a car ownership go to the registered owner. The registered owner do not pay, nor have any distraint assets. The purpose for a car owner to have a vehicle registered in the name of a car straw man is to be able to escape the financial responsibilities arising from the possession of a vehicle. The problem with car straw men has grown quickly over the past ten years, the problem was virtually unknown 15 years ago. The problem is especially big in Malmö.

The authorities have tried in different ways to stop the car straw man activities. Cars have been seized and foreclosed, car straw men have been convicted of accounting fraud and have been declared in bankruptcy. The measures have not stopped the car straw man activities. The need for new legislation has been evident for several years. The investigators had to find a law construction which effectively stops the potential for continued car straw man activities, without affecting legitimate setup. A major problem for legislators has been how the necessary restriction of ownership shall be constructed.

The legislative changes means that vehicle debts now are connected to the vehicle. The authorities can now apprehend of vehicles with at least 5000 Swedish kronor in debt if it is found parked in contravention of applicable parking regulations. If the debt is not paid, the vehicle will be scrapped or sold. An appeal with a proprietary objection can no longer achieve success since it, under the new law does not matter who owns the vehicle.

My conclusion is that the current legislative amendments will have the desired effects. Several signs point already on that this is the case. The amendments have however not yet been tried in a court. (Less)
