Abstract
The purpose with this thesis is to study prosecutors obligation to be objective during and after the preliminary investigation against the suspect. The study is based on a legal certainty perspective. The essential purpose with a principle of objectivity that has been laid down in law is to ensure every individual’s legal rights.

The general rules that apply to prosecutors will be presented initially. The Swedish Prosecution Authorities enforcement activity has been excluded from most of the general rules of administrative agencies. The exception has been justified partly because prosecutors main duties have a greater connection to the penal law, than the administrative law. The purpose with this thesis is to study prosecutors obligation to be objective during and after the preliminary investigation against the suspect. The study is based on a legal certainty perspective. The essential purpose with a principle of objectivity that has been laid down in law is to ensure every individual’s legal rights.

The general rules that apply to prosecutors will be presented initially. The Swedish Prosecution Authorities enforcement activity has been excluded from most of the general rules of administrative agencies. The exception has been justified partly because prosecutors main duties have a greater connection to the penal law, than the administrative law. Prosecutors obligation to be objective during the preliminary investigation is laid down in law thru 23 kap. 4 § RB. The requirement on prosecutors objectivity during the preliminary investigation primarily means that the prosecutor shall also take into account the circumstances and evidences that may be in benefit to the suspect. Prosecutors main goal shall not be that the suspect gets prosecuted instead it shall be that the right suspect gets prosecuted. Prosecutors obligation to be objective after the preliminary investigation, that is during the main hearing, is not laid down in law. It appears however from legislative history and doctrine that the prosecutor shall act objective during the entire criminal trial procedure, and thus also after the preliminary investigation. The opinion is divided when it comes to how far the prosecutor’s have to go in their objectivity during the main hearing. There is a debate whether the prosecutor has a duty to present evidence in benefit of the defendants during the main hearing. The common view seems to be that if information comes to light during the main hearing, which is in benefit of the defendant, the prosecutor must take it into account. During the main hearing the prosecutor shall aim for an objectively correct judgment not a conviction. The requirement on prosecutors objectivity is in principle without exception. The regulation on prosecutors obligation to be objective during and after the preliminary investigation is considered to fulfil the requirement of legal certainty. (Less)

Uppsatsens syfte är att studera åklagarens objektivitetsplikt under och efter förundersökningen gentemot den misstänkte. Studien utgår från ett rättssäkerhetsperspektiv. Det grundläggande syftet med en genom lag fastslagen objektivitetsprincip är att säkerställa den enskildes rättssäkerhet.

De generella reglerna som gäller för åklagare kommer att presenteras inledningsvis. Åklagarmyndighetens brottsbekämpande verksamhet har undantagits från större delen av de generella reglerna för förvaltningsmyndigheter. Kravet på åklagarens objektivitet under förundersökningen innebär främst att åklagaren ska beakta även de omständigheter och bevis som kan vara till fördel för den misstänkte. Åklagarens huvudsakliga mål ska inte vara att den misstänkte åtalas utan att rätt misstänkt åtalas. Åklagarens objektivitetsplikt efter förundersökningen, det vill säga under huvudförhandlingen, är inte lagstadgad. Det framgår dock av förarbeten och doktrin att åklagaren ska agera objektivt under hela brottmålsprocessen och således även efter förundersökningen. Det råder delade meningar kring hur långtgående åklagarens objektivitetsplikt är under en huvudförhandling. Det är stridigt om åklagaren har en skyldighet att lägga fram bevisning som talar till den tilltalades fördel under en huvudförhandling. Den gemensamma uppfattningen tycks dock vara att om det framkommer uppgifter under huvudförhandlingen som är till den tilltalades fördel så ska åklagaren beakta dessa. Under huvudförhandlingen ska åklagaren sträva efter en objektivt riktig dom, inte en fällande dom. Kravet på åklagarens objektivitet är i princip undantagslös. Regleringen av åklagarens objektivitetsplikt under och efter förundersökningen anses uppfylla kravet på rättssäkerhet. (Less)
