Uppsatsen ämnar undersöka förhållandet mellan bevarandet och det hållbara nyttjandet av biologisk mångfald inom Arktis och det internationellrättsliga beaktandet av den redan befintliga kunskapen om detta arbete som finns bevarad hos områdets urfolk. På det internationellrättsliga området finns internationella miljöavtal som utgår från att denna kunskap bör och skall bevaras och tas till vara. Det historiska fokuset på konservering snarare än hållbart nyttjande har visat sig slå hårt mot urfolkens traditionella leverne, medan hållbart nyttjande som strategi ligger mer i linje med detta. Uppsatsen ämnar undersöka förhållandet mellan bevarandet och det hållbara nyttjandet av biologisk mångfald inom Arktis och det internationellrättsliga beaktandet av den redan befintliga kunskapen om detta arbete som finns bevarad hos områdets urfolk. På det internationellrättsliga området finns internationella miljöavtal som utgår från att denna kunskap bör och skall bevaras och tas till vara. Det historiska fokuset på konservering snarare än hållbart nyttjande har visat sig slå hårt mot urfolkens traditionella leverne, medan hållbart nyttjande som strategi ligger mer i linje med detta. Arktiska rådet är sin status som soft law organisation till trots den främsta aktören för att sätta tonen för normbyggandet i regionen och dess internationellt sett unika sammansättning och sin tydliga inkludering av urfolk ligger i framkant. Genom Arktiska rådet har de arktiska staterna en stor möjlighet att utveckla skyddet av den biologiska mångfalden i enlighet med sina åtaganden i Konventionen om biologisk mångfald. Diskussioner förs även om det ökande inflytandet av urfolkens traditionella ekologiska kunskap innebär en utveckling av förståelsen av hållbar utveckling som sådant. (Less)

This thesis aims to investigate the relationship between the preservation and sustainable use of biological diversity in the Arctic and the consideration within international environmental law of the already existing knowledge on the area that the Arctic indigenous peoples are holders of. In international environmental law there are multilateral environmental agreements that assume that this knowledge should be maintained and made use of. The historical focus on conservation rather than sustainable use has been shown to affect indigenous lifestyles negatively, while the sustainable use approach is more aligned with indigenous peoples’ traditional ways of life. This thesis aims to investigate the relationship between the preservation and sustainable use of biological diversity in the Arctic and the consideration within international environmental law of the already existing knowledge on the area that the Arctic indigenous peoples are holders of. In international environmental law there are multilateral environmental agreements that assume that this knowledge should be maintained and made use of. The historical focus on conservation rather than sustainable use has been shown to affect indigenous lifestyles negatively, while the sustainable use approach is more aligned with indigenous peoples’ traditional ways of life. The Arctic Council is, despite its status as a soft law organization, the main actor in developing international norms in the Arctic region, and its internationally unique composition and inclusion of indigenous peoples is in the forefront. Through the Arctic Council the Arctic states have a great possibility in developing the protection of biological diversity according to the Convention on Biological Diversity. Discussions will also be held whether the increasing influence from indigenous peoples’ traditional ecological knowledge also means a development in the understanding of the concept of sustainable development as such.
