- I denna uppsats undersöks vilka rättsliga följder olovliga dataslagningar på arbetsplatsen ger. Arbetet har utgått ifrån arbetstagarens perspektiv och analyserats utifrån att denne begått dataintrång eller misstänks för att begått dataintrång.
Min undersökning inleds med en genomgång av rättsreglerna, följd av en granskning av rättsfall för att få en överblick på den praktiska tillämpningen.
Mina frågeställningar har bestått i hur de rättsliga följderna ser ut inom tre olika rättsområden; straffrätten, arbetsrätten och i förekommande fall offentligrätten, närmare bestämt den rättsliga delen som avser yrkeslegitimationsfrågor. En övrig frågeställning som undersökts är hur arbetsmarknadsparterna ser på otillåtna dataslagningar på arbetsplatsen och vilka uppfattningar det finns bland arbetsmarknadens parter. Detta har belysts genom intervjuer med hur några representanter för arbetsmarknadens parter ser på de olovliga dataslagningarna ur praktikerns perspektiv. (Less) - Abstract
- This paper examines the legal consequences of illegally accessing protected data in the workplace. The study begins with a scrutiny of relevant legal rules, followed by a review of court cases to get an overview of the practical implementations.
Questions raised deal with the legal implications in three different areas of law; criminal law, labour law and, where appropriate, public law, specifically the legal part relating to professional certification issues. Another question is how the various judicial bodies interact and if there is a risk of possible violations of the ne bis in idem-principle.
The aim is to examine court verdicts on illegal access to protected data and to analyse the various courts line of argumentation.
