Abstract
Crimes with racist motives have since long been particularly important for society to oppose. This study examines amongst other questions issues concerning right-wing groups who have in spite of this acted in Sweden.
Three groups were examined, Nordiska rikspartiet, Svenskarnas parti and Svenska motståndsrörelsen. The only existing group today is Svenska motståndsrörelsen. It is estimated that Svenska motståndsrörelsen will be able to grow but not to an extent in which it can be a real threat to our democratic social structure.

Crimes with racist motives have since long been particularly important for society to oppose. This study examines amongst other questions issues concerning right-wing groups who have in spite of this acted in Sweden.
Three groups were examined, Nordiska rikspartiet, Svenskarnas parti and Svenska motståndsrörelsen. The only existing group today is Svenska motståndsrörelsen. In 2013 there were just over 5500 hate-crimes committed in Sweden according to The Crime Prevention Council, (Brå). In this study I present hate-crime statistics and hate-crime definitions from The Crime Prevention Council. From these statistics you can read that a part of these crimes were committed of persons linked to the right-wing groups.

Also in this study is examined the hate crime regulation in BrB 16:8 with equality before the law concerning the protected groups as theoretical approach.
Examination of legislative texts, preparatory works, doctrine and case law gives how the three requisites are to be applied and interpreted.
In the study is attention brought to that the regulations application has been limited due to the Supreme Court’s rulings with reference to freedom of speech and religion given in the European convention on human rights.
In current cases have offensive expressions against homosexuals been accepted. Therefore have homosexuals as a group in comparison to other groups protected by the regulation not the same extensive protection in practical application. This applies to expressions in a religious context. More rulings from the Supreme Court are desirable to decide if the limited application includes all of the ethnical groups or only homosexuals.

In this study is the penalty increase regulation in BrB 29:2 p.7 examined. The examination is made from legislative text, preparatory works and doctrine. The examination shows that the regulation is well balanced, better than BrB 16:8, and that that there is no need to alter it.
In the study is also presented an examination from the Prosecutor´s Office that shows that the regulation, when applied, has impact on the penalty. (Less)

Brott med rasistiska motiv har från samhällets sida länge varit särskilt angelägna att bekämpa.
I denna uppsats behandlas bland annat frågor rörande de högerextrema grupperingar som trots detta verkat i Sverige.
Tre grupperingar undersöks, Nordiska rikspartiet, Svenskarnas parti och Svenska motståndsrörelsen. Av dessa existerar i skrivande stund endast Svenska motståndsrörelsen som bedöms kunna växa men inte till sådan omfattning att de kan utgör ett verkligt hot mot vårt demokratiska samhällsskick.

Vidare i uppsatsen undersöks hatbrottsbestämmelsen i BrB 16:8 med utgångspunkt i likhet inför lagen gällande de grupper som omfattas av bestämmelsens skydd.
Undersökningen av lagtext, förarbeten doktrin och praxis ger hur bestämmelsens tre rekvisit ska tillämpas och tolkas.
I uppsatsen uppmärksammas att paragrafens tillämpningsområde inskränkts av senare praxis från Högsta domstolen på grund av det skydd för yttrandefrihet och religionsutövning som ges av Europakonventionen för mänskliga rättigheter.
I aktuella fall har kränkande uttalanden mot homosexuella accepterats vilket kan sägas ha inneburit att homosexuella som grupp inte kunnat omfattas av samma skydd som de andra omnämnda grupperna i bestämmelsen i praktisk tillämpning. Dessa fall gäller yttranden som har fällts i religiösa sammanhang. Ytterligare rättspraxis från Högsta domstolen vore önskvärd för att avgöra om det minskade skyddet även ska omfatta andra grupper eller fortsatt bara ska gälla skydd för sexuell läggning.

I uppsatsen undersöks även straffskärpningsregeln i BrB 29:2 p.7. Undersökningen grundar sig på lagtext, förarbeten och doktrin. Undersökningen ger att bestämmelsen är väl avvägd, bättre än BrB 16:8, och att det inte kan anses föreligga något behov av att i dagsläget förändra den.
Vidare presenteras en undersökning från åklagarmyndigheten som visar att bestämmelsen vid dess praktiska tillämpning i domstol får genomslag i straffskärpande riktning. (Less)
