Abstract
The legal cases concerning unwanted online publishing of private material have experienced a significant rise in the last few years peaking around 2012 in Sweden, with initial assiduities around the issue being brought about by the “Instagram riots”. Up to this day, there is yet to be a collective term to entirely encompass these cases, and although the specific details differ between each case, there is an apparent common thread in the majority of the assessments – defamation. The core problem goes beyond the protection of individual honour, which lay at the heart of Sweden’s criminal chapter on defamation. The legal cases concerning unwanted online publishing of private material have experienced a significant rise in the last few years peaking around 2012 in Sweden, with initial assiduities around the issue being brought about by the “Instagram riots”. Up to this day, there is yet to be a collective term to entirely encompass these cases, and although the specific details differ between each case, there is an apparent common thread in the majority of the assessments – defamation. The core problem goes beyond the protection of individual honour, which lay at the heart of Sweden’s criminal chapter on defamation. How to name the appearance however, tend to depend on the actual circumstances.

In this essay I aim to investigate this subject whilst maintaining a hold of the bigger picture. In light of this, along with the absence of a collective term, I created Tendency X (X), an abstract premise that serves to represent the essence of selected common core values appearing in Swedish Case Law. While analysing a selected amount of repre- sentative legal cases (the majority from within the last few years) and deconstructing them to study what they have in common, I formed X. In the subsequent parts, X is therefore defined as something, usually a type of defamation inclusive of (a) sexual nature, (b) concerning two individuals, and (c) takes place online. Currently, "X-cases" seems to be judged mainly as defamation, for this reason the legal scope of this thesis will focus mainly on the present and historical legislation on defamation. This investiga- tion will focus on the following questions: (1) How does the interest of protection relate to X? (2) In what way does the legislation on defamation constitute protection against X? and (3) How can other areas of law instead of, or in combination with defamation, offer legal protection in relation to X?

The original form of the legislation on defamation has proven to be useful in relation to X. Characteristic of X is also that it can often be covered by several sections of the law, as well as by the European Convention on Human Rights, and these are at times not strong enough to fully capture the presumed offense or protect the values worthy of legal protection. X also opens up many legal questions around what is to be considered the off- and online reality. This led me towards the field of sociology of law to examine and identify various matters from which to build different starting points of possible solutions. I have therefore introduced the concepts of honour and capital from Bour- dieu’s vocabulary to discuss how X could be understood from an alternative way to law. These conclusions serve to relate X to a variety of legal provisions, mainly from within the national penal code, to evaluate the actual possibility of legal protection for the individuals. The result shows that there are several options that might be useful in order to uphold the individual’s rights; however, carrying this out appears both unpredictable and relative. In order to analyse the situation and thereby attempt to find openings to various directions of future solutions the bigger picture of how X can be interpreted, is essential.

Finally, I have identified proposals as grounds for discussion on how X can be handled by the law. These proposals can be viewed as openings for further exploration in the field, however, X brings on the fact that there is a certain area worth protecting that is not covered by a corresponding protection in the law. Antalet rättsfall gällande oönskad publicering och spridning av andra människors privata material på Internet har ökat betydligt de senaste åren, med de s.k. Instagramupploppen 2012 som en sorts uppmärksamhetskulmen. Inget svenskt samlingsnamn som passar i alla dylika sammanhang har uppkommit och även om specifika detaljer skiljer sig åt från fall till fall, förefaller ärekränkningar förekomma som en röd tråd i de flesta bedömningar. Huvudproblemet sträcker sig dock utanför skyddet av individens ära som är kärnan i förtalsparagrafen. I denna uppsats undersöks de specifika fallen samtidigt som en helhetssyn behålls. På grund av detta diskuteras vad jag kallat Tendens X (X), en abstrakt premiss som tjänar till att representera essensen av den utvalda värdegrund som förekommer i svensk rättspraxis. X har definierats genom en dekonstruerande granskning av en utvald mängd representativa rättsfall (de flesta från de senaste åren). Utifrån de gemensamma nämnarna, definieras X därför i de efterföljande delarna som en typ av förtal som består av (a) sexuell karaktär (b) mellan privatpersoner (c) och sker på internet. Huvudsakligen tycks X-fall i dagsläget bedömas som förtal varför det är det lagrummet som uppsatsen främst undersökt, även med en viss historisk tillbakablick. Uppsatsen kommer därför att utgå från frågeställning- arna: (1) Hur kan skyddsintresse förstås i förhållande till Tendens X? (2) På vilket sätt utgör förtalsbestämmelsen ett skydd mot Tendens X? Och (3) Hur kan andra rättsområden istället för, eller i kombination med förtal erbjuda rättsligt skydd i förhållande till Tendens X?

Trots att förtalsbestämmelsen i princip sett likadan ut sedan den infördes har den visat sig vara användbar i förhållande till X. Utmärkande för X är även att dess handlingar ofta täcks av flera lagrum, och EKMR, där emellanåt inget är tillräckligt starkt för att i sig självt kunna fånga det presumtiva brottet och därmed värna skyddsintresset. Tendens X- fall öppnar alltså upp för många juridiska frågor som återfinns i ett fält mellan den verklighet som utspelar sig online och den verklighet som är offline. Detta har även lett mig till att ta ett steg mot rättssociologins håll för att genom dess växelverkan med juridiken försöka identifiera olika utgångspunkter genom vilka olika lösningskombinat- ioner skulle kunna utvinnas. Jag har därför som teori introducerat Bourdieus begrepp ära och kapital för att kunna resonera om hur X ska förstås på ett annat än ett strikt juridiskt sätt. Resultatet visar att fastän det finns flera konstellationer av rättsliga bestämmelser, huvudsakligen inom straffrätten, som i och för sig kan vara användbara för att upprätthålla individens rättigheter så medför detta både oförutsägbarhet och relativitet. Den större bilden blir därför central för att analysera situationen och därigenom försöka hitta öppningar till olika riktningar för framtida lösningar.

Avslutningsvis har jag identifierat ett par förslag som öppnar för diskussion om hur X skulle kunna hanteras inom juridiken. Förslagen skulle kunna betraktas som möjliga nya ingångar för vidare studier på området men kan sammanfattas med konklusionen att existensen av X innebär att det numera finns ett skyddsintresse utan ett direkt korresponderande och erforderligt lagskydd.
