Abstract (Swedish)
Detta examenarbete behandlar tillämpningen av den nya regeln om
strafflindring vid medverkan i utredningen av sin egen brottslighet i 29 kap
5 § 5 p BrB. För att förstå dess tillämpning har de bakomliggande
rättspolitiska motiven till bestämmelsen undersökts. Uppsatsen fokuserar på
eventuella skillnader i motiven vid införandet av billighetsskälen genom
1989 år reform och de motiv som anförts vid reformen av bestämmelsen
2015. Undersökningen jämför den nya bestämmelsen om medverkan i
utredningen av sin egen brottslighet med de tidigare punkterna i
bestämmelsen som vilar på samma grund – Skademotverkande- och
Självangivelsefallen i 29 kap 5 § 4-5 p BrB. Genom att förstå de punkterna

Detta examenarbete behandlar tillämpningen av den nya regeln om
strafflindring vid medverkan i utredningen av sin egen brottslighet i 29 kap
5 § 5 p BrB. För att förstå dess tillämpning har de bakomliggande
rättspolitiska motiven till bestämmelsen undersökts. Uppsatsen fokuserar på
eventuella skillnader i motiven vid införandet av billighetsskälen genom
1989 år reform och de motiv som anförts vid reformen av bestämmelsen
2015. Undersökningen jämför den nya bestämmelsen om medverkan i
utredningen av sin egen brottslighet med de tidigare punkterna i
bestämmelsen som vilar på samma grund – Skademotverkande- och
Självangivelsefallen i 29 kap 5 § 4-5 p BrB. Genom att förstå de punkterna
ökar förståelsen för hur den nya bestämmelsen kommer tillämpas. De utgör
även en god grund för att formulera vissa problem- och frågeställningar som
punkterna delar. Utöver detta har den rättspraxis redovisats där den nya
punkten tillämpats. Rättsfallen går igenom vilken bevisning som funnits vid
medverkans påbörjande, vad medverkan bestått i samt vilken reduktion på
straffet det inneburit. Det är främst avgöranden från tingsrätterna som
analyserats, men även något hovrättsfall. Rättsfallen har inte använts för att
beskriva gällande rätt, de har använts för att förstår hur bestämmelsen
tillämpats av domstolarna. Det visar vilka brott bestämmelsen tillämpats vid
och utgör en bra plattform för att diskutera de problem och frågor som tagits
upp tidigare i uppsatsen.
Billighetsskälen lämnar utrymmet för ändamålstolkning. Motiven till
bestämmelsen blir därför viktig för dess tillämpning. Dessa motiv undersöks
i arbetet. Min förhoppning är att läsaren reflekterar över vilka motiv de vill
ska vara styrande för billighetsskälen. (Less)
Abstract
This final thesis is about the application of the new rule regarding reduction
of sentence if the accused participate in the investigation of his own crime in
chapter 29 article 5 number 5 of the Swedish Penal Code. This new
provision makes it possible for the accused to affect the outcome of the
sentence. It is therefore important to understand what level of participation
is required for the rule to be applicable and how large the reduction will be.
Numerous judgements from the first court instance have therefore been
analysed in an attempt to clarify this. The judgements have not been used to
describe the law. They have been used to describe how the courts have
applied the law.

This final thesis is about the application of the new rule regarding reduction

provisions in the same rule regarding acts to limit the damage from the
crime or if the perpetrator voluntary turn him- or herself in to the police in
chapter 29 article 5 number 4-5 of the Swedish Penal Code. These earlier
provisions give some answers to how the new rule will be applied. The
ambition is to answer questions such as if the accused have to show signs of
remorse for the provision to be applicable.
The paper is also highly focused on which political motives that gives
ground for the reduction of sentence and how these motives have changed
with the reform of the provision in 2015. These motives can be important
for the application of the provision why they are interesting. The goal with
this final thesis is to make it easier for practicing lawyers and people who
get accused of a crime to understand which possibilities they have to
comply with the police, and what benefits it could mean. (Less)
