Majoriteten av det stora antal personer som har ett alkoholmissbruk befinner sig i arbetslivet. Arbetsgivare innehar en viktig roll när en arbetstagare drabbas av ohälsa eller sjukdom eftersom att det på en arbetsplats finns särskilda möjligheter att tidigt upptäcka dessa problem. Lider en arbetstagare av alkoholmissbruk föreligger det i många fall ett rehabiliteringsansvar hos arbetsgivaren.

Uppsatsen syftar till att undersöka vilken påverkan en sjukdomsdiagnos på arbetstagarens missbruk kan få för arbetsgivarens rehabiliteringsansvar. Vi använder oss av rättsdogmatisk metod för att söka svar på vår frågeställning i gällande rätt. Lider en arbetstagare av alkoholmissbruk föreligger det i många fall ett rehabiliteringsansvar hos arbetsgivaren.

Uppsatsen syftar till att undersöka vilken påverkan en sjukdomsdiagnos på arbetstagarens missbruk kan få för arbetsgivarens rehabiliteringsansvar. Vi använder oss av rättsdogmatisk metod för att söka svar på vår frågeställning i gällande rätt. Enligt huvudregeln utgör sjukdom inte saklig grund för uppsägning och det åligger arbetsgivaren att vidta de åtgärder som skäligen kan krävas för att arbetstagaren ska kunna kvarstå i anställningen. Hur långtgående arbetsgivarens rehabiliteringsansvar är utvecklas genom Arbetsdomstolens praxis. Det förefaller inte vara arbetstagarens sjukdomsdiagnos i sig som får den avgörande betydelsen för arbetsgivarens ansvar, fall som likställs med sjukdom bedöms på ett liknande sätt. Även omständigheterna i det enskilda fallet har stor betydelse. (Less)

An employer has a key role when an employee suffers from illness or disease, due to the special opportunities existing at a workplace to detect these issues at an early stage. The majority of the large number of people suffering from alcohol abuse are in working life. An employer has a key role when an employee suffers from illness or disease, due to the special opportunities existing at a workplace to detect these issues at an early stage. When an employee suffers from alcohol abuse the employer in many cases has a responsibility for rehabilitation.

The aim of our thesis is to examine what impact a diagnosis of disease of the employee's alcohol abuse has on the employer's responsibility for rehabilitation. In order to answer our question we use the method of "legal dogmatic approach" and seek answers in applicable legislation. The principal rule is that disease is not a just cause for termination of employment. The employer is responsible for taking the measures needed to facilitate for the employee to remain in employment. The Labour Court's practice develops how far the employer's responsibility for rehabilitation reaches. It seems that the disease diagnosis in itself is not of crucial importance for the employer's liability. In the Labour Court some cases are treated as caused by disease although there is no such diagnosis. The circumstances play a major role in the individual case. (Less)
