- Abstract
- In 2015, about 33 568 unaccompanied children crossed the Swedish border and applied for asylum. Most of these asylum seekers were from “failed states” so they lacked documents that can prove their identity. Therefore, in doubtful cases, the Swedish Migration Agency conduct age assessments. But the methods of age assessment have been heavily criticized by experts of different fields. This thesis investigated the guidelines of the age assessment of unaccompanied children and whether such guidelines are in compliance with the analytical dimensions of legal certainty: predictability, the right to appeal and the authority obligation to investigate. This was achieved by combing an evaluation analysis and idea analysis. The result reveal that the guidelines mostly do not comply with legal certainty, with just a few exceptions. In conclusion, the thesis exposes an inadequacy of the asylum process, a part which plays a crucial role for vulnerable unaccompanied children. (Less)
