Straffrättsvillfarelse – Om gränsdragning och ursäktlighet vid straffrättsvillfarelse

- Uppsatsens övergripande syfte är att på basis av tre rättsfall, undersöka och kritiskt granska hur frågor om straffrättsvillfarelse hanteras inom svensk rätt. Uppsatsen utgår från två frågeställningar: När bedöms en villfarelse som relevant för uppsåtstäckningen och när bedöms den vara en straffrättsvillfarelse? Vad måste föreligga för att en straffrättsvillfarelse ska kunna bedömas som uppenbart ursäktlig?
Både frågan om gränsdragning och frågan om ursäktlighet bottnar i en intressekonflikt mellan konformitetsprincipen och effektiviteten inom rättstillämpning.

Vad måste föreligga för att en straffrättsvillfarelse ska kunna bedömas som uppenbart ursäktlig?
Både frågan om gränsdragning och frågan om ursäktlighet bottnar i en intressekonflikt mellan konformitetsprincipen och effektiviteten inom rättstillämpning.
Gränsdragningen mellan relevant villfarelse och straffrättsvillfarelse avgörs genom en tillämpning av täckningsprincipen. Det är en fråga om att utifrån ett straffbuds rekvisit, avgöra vad gärningspersonens uppsåt ska ha täckt. Gränsdragningen blir komplicerad när brottsrekvisiten utgörs av speciellt-juridiska begrepp, t.ex. ”äganderätt”. I de fallen avgörs gränsdragningen från brottstyp till brottstyp och skiljelinjen mellan relevant villfarelse och straffrättsvillfarelse är ofta subtil. Denna flexibla lösning öppnar upp för en inkonsekvent rättspraxis, vilket ett av de granskade rättsfallen visar. Gränsdragningen kan ibland framstå som godtycklig.
För ansvarsbefriande straffrättsvillfarelse krävs enligt lagtexten att villfarelsen är uppenbart ursäktlig. I förarbeten har det inte närmare förklarats hur ursäktligheten ska bedömas. Fokus har istället legat på fyra typfall då ansvarsfrihet borde meddelas. HD har i ett av rättsfallen tolkat lagtexten som att ansvarsfrihet p.g.a. straffrättsvillfarelse i första hand ska inträda vid de fyra typfallen och i andra hand i mycket särpräglade fall.
Därav verkar mycket höga krav på ursäktlighet ställas för att ansvarsfrihet ska kunna meddelas. HD:s tolkning framstår som bristfällig dels utifrån lagstiftarens intentioner och dels utifrån konformitetsprincipen. I jämförelse med ett av de granskade hovrättsfallen, framstår ursäktlighetsbedömningen i praxis som inkonsekvent och otydlig vid straffrättsvillfarelse. (Less) - Abstract
- The main purpose of the paper is to examine and critically view how questions concerning an offender’s error or ignorance of criminal law (straffrättsvillfarelse) are being managed in Swedish law, on the basis of three court cases. The paper attempts to answer two questions: When is an offender’s error or ignorance considered relevant for the test of intent and when is it considered a straffrättsvillfarelse? What is required for a straffrättsvillfarelse to be considered clearly excusable, and therefore leading to a verdict of acquittal?
This question of demarcation is answered through investigating the criminal provision’s necessary conditions and what the offender’s intent must cover. This is complicated when the provision’s necessary... The dividing line between relevant error/ignorance and straffrättsvillfarelse is very subtle in those cases. This flexible solution opens up for an inconsistent case law, as one of the examined cases shows, and the demarcation might seem coincidental.
For a straffrättsvillfarelse to acquit the offender, it must be clearly excusable according to the provision. What clearly excusable means, is a bit unclear in the legislative history. The focus in legislative history has been four typical cases of clearly excusable straffrättsvillfarelse. The Supreme Court of Sweden has in one the examined cases, interpreted that, apart from the typical cases, straffrättsvillfarelse can only be clearly excusable in very odd cases.
Through the Supreme Court’s interpretation, it seems that extremely high demands are put on the offender for his straffrättsvillfarelse to be clearly excusable. Based on the legislator’s intention and general principles of criminal law, the interpretation of the Supreme Court seems inadequate. In comparison with the interpretation made in another of the examined cases, the assessment of straffrättsvillfarelse in case law seems inconsistent and unclear. (Less)
