Psykisk störning i brottmål - Vem bär ansvaret? - En studie om vem som bär ansvar för tilltalade med psykisk störning i svensk brottmålsprocess

Abstract
To be the defendant in a court room is a situation of vulnerable exposition. When suffering from psychiatric disorders, the defendant is likely to be even more vulnerable. The question is who carries the responsibility to deliver adequate support in order to ensure the defendant receives a fair trial.

The aim with this paper was to investigate the prosecution of defendants suffering from psychiatric disorders and to investigate the responsibility of making sure the defendant is given adequate support. To be the defendant in a court room is a situation of vulnerable exposition. When suffering from psychiatric disorders, the defendant is likely to be even more vulnerable. The question is who carries the responsibility to deliver adequate support in order to ensure the defendant receives a fair trial.

The aim with this paper was to investigate the prosecution of defendants suffering from psychiatric disorders and to investigate the responsibility of making sure the defendant is given adequate support. The ability to get support from the different actors of the court and from the county will be examined. Problems, which can occur during a trial, will be presented. The grey area surrounding mental health and the problems regarding who is in need of special support will be highlighted.

The finding points out that it is the attorney who holds the main responsibility. All actors of the court share the responsibility for a fair trial. But due to the different roles in the trial, the attorney is the one who is able to give the defendant support. After comparing research on forensic psychology with the treatment during trial and the treatment of the defendant, the conclusion is that the current situation is insufficient and might result in an unfair trial for those who suffer from psychiatric disorders.

In order to combat these flaws, the actors in the court room must be educated on psychiatric disorders. Opening the courtroom to other parties could also serve as a solution. For example, the defendant could be offered support, possibly arranged by the county. There is no doubt that if all parties had a better understanding of psychiatric disorders the problems and the vulnerability of the defendant would decrease. Everybody needs to take responsibility for the vulnerable defendant in criminal proceedings. (Less)

Att stå som tilltalad i en brottmålsprocess är en utsatt situation. Har den tilltalade en psykisk störning kan vi tala om en särskilt utsatt situation. Frågan är vem som bär ansvar för att den tilltalade med psykisk störning får det stöd denne är i behov av, för att effektivt kunna delta i förfarandet och få en rättvis rättegång.

Syftet med undersökningen har varit att utreda hur man i dagens brottmålsprocess hanterar tilltalad med psykisk störning, samt vem som ansvarar för att denne får stöd i domstolsprocessen. Utifrån undersökningen kan konstateras att advokaten bär ansvaret. Alla rättssalens aktörer har ansvar för att processen ska bli rättvis, men med anledning av domarens mindre aktiva roll i en ackusatorisk straffprocess, samt med anledning av att åklagaren utgör part i rättegång kan främst advokaten agera stöd. Efter jämförelse mellan rättspsykologisk forskning och dagens domstolsprocess kan konstateras att rättsläget inte är helt tillfredsställande. Att tillgodose individuella behov hos den tilltalade kan möta svårigheter och det finns därmed risk att rättegången inte blir rättvis för den tilltalade som har en psykisk störning.

För att lösa detta krävs främst större psykologisk kunskap hos aktörerna i rättssalen. Att förordna en stödperson för den tilltalade skulle även kunna fungera tillfredsställande, vilket eventuellt skulle kunna ligga inom kommunens ansvar. Ostridigt är att med kunskap om psykiska störningar kan problem och den tilltalades utsatthet minska. Alla behöver ta sitt ansvar för den särskilt utsattes ställning i brottmålsprocessen. (Less)
