- Fördelningen av felansvaret vid överlåtelse av fast egendom utgår från köparens undersökningsplikt såtillvida att köparen ansvarar för upptäckbara fel medan ansvaret för dolda fel stannar hos säljaren. Samtidigt som köparen måste vidta en undersökning av fastigheten åläggs säljaren en upplysnings-plikt och fastighetsmäklaren en rådgivnings- och upplysnings¬skyldighet. Samtidigt som köparen måste vidta en undersökning av fastigheten åläggs säljaren en upplysnings-plikt och fastighetsmäklaren en rådgivnings- och upplysnings¬skyldighet. Syftet med uppsatsen är att utreda hur långtgående köparens undersöknings-plikt är och hur undersökningsplikten och därmed felansvarets fördelning påverkas av säljarens upplysnings¬plikt, fastighetsmäklarens rådgivnings- och upplysningsskyldig¬het samt besiktningsmannens medverkan vid undersökningen av fastigheten. Vidare undersöks om felansvarets fördelning stämmer överens med lagstiftarens intentioner.
Köparens undersökningsplikt är ett levande institut vars omfattning avgörs utifrån omständigheterna i det enskilda fallet. En objektiv bedömning av vad köparen bör upptäcka görs utifrån vad en normalt kunnig och erfaren lekman hade upptäckt vid en noggrann undersökning av fastigheten. Vidare görs en subjektiv bedömning av vad köparen i det enskilda fallet borde ha upptäckt. Den subjektiva bedömningen påverkas av uppgifter från säljaren såtillvida att de kan utöka eller reducera undersökningsplikten. Köparens normala undersökningsplikt, så som den kommer till uttryck i lagtext och förarbeten, kan inte anses vara långtgående då den kortfattat innebär att köparen ska vidta en undersökning av fastighetens yttre delar, en så kallad okulär undersökning. Det är först när undersökningsplikten påverkas av yttre faktorer utanför köparens kontroll i form av information från säljaren och fastighetsmäklaren som den kan sägas vara långtgående. Ju mer information köparen får om fastigheten, desto större del av felansvaret övergår från säljaren. Fördelningen av felansvaret har således kommit att påverkas av faktorer som lagstiftaren inte beaktat med konsekvensen att köparen i många fall åläggs en större del av felansvaret än vad som varit lagstiftarens intentioner. - The allocation of liability for defects at a property transaction is based on the buyer’s obligation to inspect the property, inasmuch the buyer is held responsible for discoverable defects while the seller is held responsible for not detectable defects. On one hand the buyer is required to perform an inspection of the property while on the other the seller and real estate agent are required to inform the seller on known defects according to the disclosure duty. - The allocation of liability for defects at a property transaction is based on the buyer’s obligation to inspect the property, inasmuch the buyer is held responsible for discoverable defects while the seller is held responsible for not detectable defects. On one hand the buyer is required to perform an inspection of the property while on the other the seller and real estate agent are required to inform the seller on known defects according to the disclosure duty. The purpose of this essay is to investigate the extent of the buyer’s obligation to inspect and how the allocation of liability for defects is affected by the seller’s and the real estate agent’s obligation to inform. Additionally, special attention is given to the fact that the duty to inspect is often fulfilled by the hiring of a professional surveyor and the potential impact this has on the division of liability. The essay also aims to investigate if the current allocation correlates with the legislator’s intention.
The extent of the buyer’s obligation to inspect is found to be shifting and is determined in the individual case. An objective judging is performed based on what an average layman could normally be expected to find during a thorough examination of the property. Added to this is a subjective judging of defects that the buyer should have found during the examination. The subjective judging is affected by the extent of disclosure by the seller in accordance with the duty to inform. The buyer’s duty to inspect cannot, as expressed in legal text, be said to be far reaching in the normal case since it only extends to a visual examination. The duty to inspect is extended by information on defects given by the seller and real estate agent. With additional information the duty to inspect is extended with the effect that a larger share of the liability of defects is allocated to the buyer. Thus the allocation of liability has come to be affected by factors not anticipated by the legislature. One consequence of this is that the buyer is imposed with a greater share of the allocation of liability than was the intention of the legislator. (Less)
