Narkotika, farlighet och notorietet - Om farlighetsbedömningens funktioner och konsekvenser i narkotikabrottmålsprocessen

- I svensk rättspraxis rörande narkotikabrott har brottsrubriceringsfrågor och
straffvärdebedömning länge utgått från resonemang om art och mängd
narkotika. Genom Mefedrondomen, som meddelades av HD i juni 2011,
initierades en praxisomläggning som innebar att art och mängd narkotika i
fortsättningen skulle tillmätas mindre betydelse vid grövre
narkotikabrottslighet. För ringa narkotikabrott och narkotikabrott av
normalgraden accepterades att bedömningen även i fortsättningen utgår
endast från omständigheterna art och mängd. En förutsättning för att kunna
beakta dessa omständigheter är att det går att jämföra olika narkotikaklassade
preparat med varandra i farlighetshänseende. Av Mefedrondomen framgår att

HD har gjort av olika narkotikaklassade preparat. Under åren efter
Mefedrondomen gjorde HD nya farlighetsbedömningar av olika
narkotikaklassade preparat i en rad avgöranden.
Med generella farlighetsbedömningar avser HD hur farliga olika preparat är i
förhållande till varandra. HD:s bedömningar bygger genomgående på
utlåtanden från sakkunniga förutom när det gäller heroin där uppgifterna om
farligheten främst är hämtade från förarbeten. Bedömningarna är emellertid
mycket osäkra och HD framhåller att försiktighet måste iakttas vid
rättstillämpning som grundas på de generella farlighetsbedömningarna. Trots
detta får farligheten alltid mer eller mindre betydelse både i
rubriceringsfrågan och vid straffvärdebedömningen i narkotikamål. Genom
att lägga generella farlighetsbedömningar till grund för
straffvärdebedömningen uppnås viss effektivitet i rättstillämpningen men det
innebär samtidigt att gärningspersonen i viss mån tillskrivs ett större ansvar
än vad hen gjort sig förtjänt av.
Farligheten antas dessutom vara en domstolsnotorisk omständighet vilket får
till följd att farligheten som utgångspunkt inte behöver bevisas i det enskilda
fallet om inte frågan tas upp av någon part. Det är i princip endast den
rangordning av narkotikaklassade preparat i farlighetshänseende som följer
av HD:s farlighetsbedömningar som kan omfattas av domstolsnotorietet. För
den part som vill föra motbevisning om preparatets farlighet innebär det
svårigheter då det inte är klart vilka aspekter av farligheten som beaktats när
farligheten fastställts. Detta innebär undantag från principerna om
omedelbarhet och det kontradiktoriska förfarandet, vilka utgör delar av rätten
till en rättvis rättegång. De negativa konsekvenserna av dessa undantag

The Supreme Court’s assessments are based consistently on expert advice
except for the assessment of heroin which is based primarily on information
retrieved from legislative history. These assessments are, however, very
uncertain and the Supreme Court emphasizes that caution must be exercised
in adjudication based on the general assessments of harmfulness.
Nonetheless, the harmfulness is always accorded importance both in
classification of the crime and in assessing the penal value in criminal cases
regarding drug offenses. By using general assessments of harmfulness when
deciding on the penal value the perpetrator to some extent is attributed a
greater liability than they deserve.
The harmfulness is also assumed to be a notorious circumstance in the
criminal procedure which means that the harmfulness does not need to be
proven in each case unless the issue is raised by a party. It is only the ranking
of harmfulness based on the Supreme Court’s general assessments that may
be assumed to be notorious. For a party that wants to bring in rebuttal the
harmfulness of a specific drug, difficulties will arise regarding identifying
which aspects of harm are relevant to disproof. This means exemption from
the principles of immediacy and adversarial proceedings, which are part of
the right to a fair trial. The negative impact of these exemptions primarily
affects individual drug users. (Less)
