Mamma... Varför har jag ingen pappa? - En utredning av barnets mänskliga rättigheter i förhållande till ett införande av juridisk abort

Ett av livets största beslut är beslutet om föräldraskap. Det är dessutom ett beslut som i slutändan görs av modern, eftersom det är hon som tar beslutet om abort. Härigenom uppstår en situation som inte är jämställd, vilket har orsakat en viss debatt den senaste tiden. Debatten gäller huruvida det bör finnas en rätt för fadern att göra en så kallad juridisk abort, alltså en möjlighet att avsäga sig faderskapet. Debatten är än så länge fokuserad på jämställdhetsargumentation, medan uppsatsen visar att en annan person är viktigare. Det framtida barnet som kommer växa upp utan en fader.

Ett av livets största beslut är beslutet om föräldraskap. Det är dessutom ett beslut som i slutändan görs av modern, eftersom det är hon som tar beslutet om abort. Härigenom uppstår en situation som inte är jämställd, vilket har orsakat en viss debatt den senaste tiden. Debatten gäller huruvida det bör finnas en rätt för fadern att göra en så kallad juridisk abort, alltså en möjlighet att avsäga sig faderskapet. Debatten är än så länge fokuserad på jämställdhetsargumentation, medan uppsatsen visar att en annan person är viktigare. Det framtida barnet som kommer växa upp utan en fader.

Uppsatsens syfte är att genom användning av en rättsdogmatisk metod undersöka denna konsekvens för barnet och dess förhållande till Sveriges åtaganden enligt Europakonventionen och barnkonventionen. Analysen svarar på om barnets rättigheter enligt konventionerna påverkar ett eventuellt införande av juridisk abort eller inte.

Art. 8 i Europakonventionen, tillsammans med barnkonventionen ger barnet en rätt att känna till sitt ursprung. Dessutom stadgas i barnkonventionen ett delat ansvar för föräldrarna då det gäller att tillförsäkra barnet hens rättigheter enligt konventionen, barnets bästa ska alltid sättas i främsta rummet. Staten har sedan ett subsidiärt ansvar att utifrån bästa förmåga försäkra barnet båda dennes föräldrar och deras finansiella stöd åt barnet. Uppsatsen undersöker också vilka möjligheter Sverige har att stifta lagar där avsteg görs från dessa rättigheter.

I analysen konstateras att barnets rättigheter enligt Europakonventionen och barnkonventionen påverkar ett införande av juridisk abort, eftersom sådan lagstiftning med största sannolikhet skulle medföra att Sverige brister i sina internationella förpliktelser. (Less)
Abstract
The choice to become a parent is not an easy one to make, moreover it is today a choice more likely to be made by the mother. She has the opportunity of abortion, whereas the father can’t affect his becoming a parent after the moment of conception. This constitutes a situation of inequality between the sexes, which this year has caused a debate to arise in social media as well as in news papers. It concerns male reproductive rights and more specifically the issue of the so called paper abortion. Paper abortion would make it possible for an unwilling father to renounce his fatherhood completely. The debate so far centres on equality between the sexes because of the situation mentioned above. The choice to become a parent is not an easy one to make, moreover it is today a choice more likely to be made by the mother. She has the opportunity of abortion, whereas the father can’t affect his becoming a parent after the moment of conception. This constitutes a situation of inequality between the sexes, which this year has caused a debate to arise in social media as well as in news papers. It concerns male reproductive rights and more specifically the issue of the so called paper abortion. Paper abortion would make it possible for an unwilling father to renounce his fatherhood completely. The debate so far centres on equality between the sexes because of the situation mentioned above. However, this essay shows that another person should be in the centre of this discussion, namely, the future child who will grow up without a father.

The essay aims to examine, through the use of a legal dogmatic method, this consequence for the child, in relation to the European Convention for the Protection of Human Rights and Fundamental Freedoms as well as the UN Convention on the Rights of the Child. The goal is to reach a conclusion on whether the child’s right affect a legislation on paper abortion or not.

Art. 8 of the European Convention for the Protection of Human Rights and Fundamental Freedoms, together with the Convention on the Rights of the Child, gives the right to a child to know his or her origins. It also establishes a shared responsibility for the parents when ensuring their child’s rights given by the Convention, while always putting the child’s best interest first. The state has a subsidiary responsibility to do it’s best making sure that both parents are present during the childhood as well as giving financial support to their child. The essay also examines what possibilities Sweden does have to interfere with these rights in order to benefit the reproductive rights of the father.

The conclusion of the essay is that the rights of the child do interfere with any future legislation on paper abortion, because it most likely equates Sweden’s position as one that infringes on international conventions. (Less)
