Lagprövning i Sverige och Tyskland – hur hade vår lagprövning kunnat vara?

Den här uppsatsen behandlar lagprövning i för- och efterhand och hur det fungerar i Sverige och Tyskland. Först presenteras de olika nationella systemen, och därefter redogörs det för beredningen av en lag och kritiken av dess remissförfarande. I analysen diskuteras hur situationen hade blivit annorlunda om Sverige haft samma lagprövning som i Tyskland.

Slutsatsen blir att den stora skillnaden mellan ländernas lagprövning är avsaknaden av en förhandsgranskning i Tyskland samt den abstrakta lagprövningen som den tyska författningsdomstolen besitter. Om Sverige haft en sådan abstrakt lagprövning hade lagen förmodligen blivit ogiltigförklarad i efterhand och den förordning som lagen gett stöd till hade inte kunnat meddelas.
Abstract
This essay concerns the use of judicial preview and review in Sweden and Germany. First, it is presented how judicial preview and review works in each respective system, and then the procedure of the enactment of a law is presented. In the analysis it is discussed how differently the law would've been treated, if Sweden had the same judicial review as in Germany.

The conclusion is that the greatest difference between the systems of judicial review is the lack of a judicial preview in Germany, as well as the lack of an abstract judicial review in Sweden.
