Den svenska straffrätten har under det senaste århundradet genomgått en mängd förändringar. Allt som oftast har påföljdssystemet varit utformad efter de för tillfället förhärskande bestraffningsteorierna. Det finns en lång tradition av särbehandling av unga lagöverträdare i Sverige och till viss del så tas hänsyn till andra intressen när det gäller ungdomar. Denna framställning ska besvara frågorna om vilka bestraffningsteorier som ligger bakom dagens ungdomspåföljder, hur de har påverkat den gällande rätten samt vilka konsekvenser användandet av de olika bestraffningsteorierna leder till.

Den svenska straffrätten har under det senaste århundradet genomgått en mängd förändringar. Allt som oftast har påföljdssystemet varit utformad efter de för tillfället förhärskande bestraffningsteorierna. Det finns en lång tradition av särbehandling av unga lagöverträdare i Sverige och till viss del så tas hänsyn till andra intressen när det gäller ungdomar. Denna framställning ska besvara frågorna om vilka bestraffningsteorier som ligger bakom dagens ungdomspåföljder, hur de har påverkat den gällande rätten samt vilka konsekvenser användandet av de olika bestraffningsteorierna leder till.

Särbehandlingen av unga lagöverträdare märks tydligt i de speciella ungdomspåföljderna ungdomsvård, ungdomstjänst och sluten ungdomsvård.
Det tas större hänsyn till vårdbehovet inom påföljdssystemet för unga än vad det gör i påföljdssystemet för vuxna. De senaste ändringarna av ungdomspåföljderna har lagt stor vikt vid att öka proportionaliteten, förutsebarhet och konsekvens. Innan 1999 års reform var påföljdssystemet för unga till stor del fortfarande baserat på behandlingsideologin. Vid reformerna 1999 och 2007 lades stor vikt vid proportionalitet, förutsebarhet och konsekvens. Systemet blev på så sätt mer balanserat och inte så ensidigt inriktat på vårdbehov. Vid lagändringarna 1 juli 2015 fokuserade lagstiftarna fortfarande på proportionalitet men det vägdes mot humanitet, tolerans och trovärdighet.

Att flera olika bestraffningsteorier används är nödvändigt för att ta hänsyn till alla olika intressen som är viktiga vid utformandet av ungdomspåföljderna. Men systemet behöver utformas väldigt noga för att inte idéerna ska krocka med varandra eller något intresse ta över. (Less)

Swedish penal law has undergone many changes over the last centuries. The sanction system has most often been modelled on penalization theories dominant at the time. Sweden has a long tradition of special treatment of young offenders, and other interest are to some extent taken into consideration when it comes to juvenile offenders compared to adults. This essay will answer the questions of which penalization theories the current sanctions for youths are founded upon, how these theories have affected established law and what consequences the use of the different penalization theories have had.

Swedish penal law has undergone many changes over the last centuries. The sanction system has most often been modelled on penalization theories dominant at the time. Sweden has a long tradition of special treatment of young offenders, and other interest are to some extent taken into consideration when it comes to juvenile offenders compared to adults. This essay will answer the questions of which penalization theories the current sanctions for youths are founded upon, how these theories have affected established law and what consequences the use of the different penalization theories have had.
The special treatment of young offenders is most apparent in the sanctions for juveniles: care of young persons, youth service and institutional care of young persons. More consideration is taken of the need for care of young offenders, than in the case of adults. The latest changes of the correction system for young offenders have focused on improving proportionality, predictability and consistency. Before the 1999 reform the youth correction system was still largely based on the idea that criminals should be rehabilitated and cured of their criminal tendencies. The 1999 and 2007 reforms placed great value on proportionality, predictability and consistency. The system became more balanced after the reforms and less heavily oriented toward the need for care. When the latest changes were made in 2015 the focus was still on proportionality but it was balanced against humanity, tolerance and credibility.
Use of several different theories on penalization is necessary in order to take consideration of different interests that are important in the formulation of the system of sanctions for youths. But the system has to be formulated very precisely, so that the ideas do not conflict with each other, or some particular interest dominates. (Less)
