- Abstract
- There are today people around the world who are not able to live their lives as they want. People who are oppressed, victims of violence and in worst case scenario even killed. Their committed crime is that the want to live their life, just the way they want.
Honor related violence and oppression is a problem for the whole society. This paper aims to investigate whether this problem is best fought with special legislation. In order to achieve the purpose of the paper, the established law and the honor concept has been described, as well as a few cases related to the subject. On the basis of the honor concept and relevant legislation it has been discussed whether honor based criminality should be specially and separately legislated.

Honor related violence and oppression is a problem for the whole society. This paper aims to investigate whether this problem is best fought with special legislation. In order to achieve the purpose of the paper, the established law and the honor concept has been described, as well as a few cases related to the subject. On the basis of the honor concept and relevant legislation it has been discussed whether honor based criminality should be specially and separately legislated.
The conclusions are that honor based criminality should be specially legislated. The victims right to live their lives, enjoying their human rights, are to be seen as more important than the arguments speaking against a legislation. In order to work in a crime preventive way, a special legislation on honor based criminality is what it takes. Furthermore, it is necessary to hand adequate education to every person who is likely to meet victims and/or potential perpetrators. - Världen över finns det idag flickor, kvinnor och pojkar som inte får leva ut sin fulla potential, som inte får njuta av sina mänskliga och grundläggande rättigheter och friheter. Människor som förtrycks, utsätts för våld och i värsta fall även berövas livet. Deras brott är att de vill leva sina liv, såsom de själva vill.
Hedersrelaterat våld och förtryck är ett angeläget samhällsproblem som angår alla. Denna uppsats har haft till syfte att undersöka huruvida detta problem är av sådan art att det bör regleras. För att uppnå syftet har hedersbegreppet och gällande rätt redogjorts. Det har utifrån detta diskuterats vad som talar för och emot en särreglering av hedersrelaterad brottslighet. Uppsatsen har blickat tillbaka till ett antal rättsavgöranden i syfte att se var vi har stått och var vi tycks vara på väg. Rättsavgörandena har tjänat som ett facit på hur hedersproblematiken uttrycks i rättstillämpningen, men framför allt hur den bemöts av våra domstolar.
Slutsatserna är att hedersrelaterad brottslighet bör särregleras. De skäl som talar emot en särreglering kan inte anses vara tillräckligt starka för att låta de utsatta stå och se på medan deras livsstil beslutas av någon annan. De är inte tillräckligt starka för att beröva de utsatta deras mänskliga rättigheter. En särreglering är vad som krävs för att på allvar verka brottsförebyggande. Utöver särreglering krävs det adekvat utbildning till alla myndighetspersoner som kan tänkas ha kontakt med utsatta och/eller potentiella förövare. Genom normbildning och lagstiftning kan hedersrelaterat våld och förtryck bekämpas. (Less)
