- Abstract
- The purpose of this paper is to investigate the courts use of the principle “best interests of the child” in cases involving honour-related violence. The paper starts by introducing the meaning of the word honour and honour-related violence. In short, the definition of the word honour in this context refers to the value of the family seen through your own and others eyes. If a family member (usually a girl or a woman) dishonours the family, the honour must be recreated. It is by doing so the violence and the oppression take form.
Children who are being exposed of honour-related violence can get protection and care according to the LVU, this I regulated in §2 and §3 LVU. The child can either be provided care due to her own harmful... The paper starts by introducing the meaning of the word honour and honour-related violence. In short, the definition of the word honour in this context refers to the value of the family seen through your own and others eyes. If a family member (usually a girl or a woman) dishonours the family, the honour must be recreated. It is by doing so the violence and the oppression take form.
Children who are being exposed of honour-related violence can get protection and care according to the LVU, this I regulated in §2 and §3 LVU. The child can either be provided care due to her own harmful behaviour, or due to abuse at home. The latter is the most common one in these cases.
An important regulation in this context is §1 fifth paragraph. It stipulates that the child's best interests are crucial in all decisions regarding the child.
The judgement of the child's best interests is therefore crucial in honour-related LVU-cases. It is for the court to decide what they believe is best for the child, but it is social services that has the ultimate responsibility to provide the Court with sufficient information so that the decision is made correct.
There is reason to question the strong position of social services in these cases, and also their ability to meet the child´s best interest.
The thesis includes an empirical part where honour-related LVU cases are being summarised and analysed. Among other things, the analysis discusses the courts judgement in cases where the child either takes back or changes the original story. The court must then decide if their judgement in the case will be based on the old story or the changed one. In those cases when the child agreed to be taken away, her will was crucial. But in those cases when the child contravened, her will was not as often crucial in the case. (Less) - Abstract (Swedish)

En viktig bestämmelse i sammanhanget är 1 § femte stycket LVU. Bestämmelsen stadgar att barnets bästa ska vara avgörande vid alla beslut som sker enligt lagen. Bedömningen av barnets bästa är således avgörande i hedersrelaterade LVU-mål. Det ankommer på domstolen att avgöra vad som är bäst för barnet, men det är socialnämnden som har det yttersta ansvaret att förse domstolen med tillräcklig information så att avgörandet blir riktigt. Det finns anledning att ifrågasätta socialnämndens starka position i dessa mål, och deras förmåga att tillgodose barnets bästa.
Uppsatsen innehåller en empirisk del där hedersrelaterade LVU-mål sammanfattas och analyseras. Bland annat diskuteras rättens bedömning i mål där den unge tar tillbaka eller ändrar sina uppgifter. Rätten måste i en sådan situation göra en tillförlitlighetsbedömning för att avgöra om de tidigare lämnade uppgifterna fortsatt ska ligga till grund för beredandet av LVU-vården. Barnets vilja har varit avgörande i de mål den unge själv ville omhändertas, men har inte varit avgörande i lika hög grad när den unge motsatt sig vård. (Less)
