- Denna uppsats handlar om varumärkesskyddet i 1 kap. 10 och 11 §§ VML betraktat utifrån ett rättsekonomiskt perspektiv. Dessa bestämmelser i VML föreskriver ensamrättsinnehavarens skydd och ensamrättens begränsningar. I uppsatsen beskrivs de ekonomiska konsekvenser som bestämmelserna leder till för enskilda marknadsaktörer och de ekonomiska konsekvenser som bestämmelserna leder till på marknaden. Den rättsekonomiska teorin Transaction cost economics (TCE) används för att förklara varför varumärkesskyddet i 1 kap. 10 och 11 §§ VML leder till dessa ekonomiska konsekvenser och för att undersöka huruvida varumärkesskyddet kan rättfärdigas utifrån denna rättsekonomiska teori eller inte. - This essay examines the protection of trade marks which is prescribed in the tenth and eleventh paragraph in the first chapter of the swedish law VML from a perspective of law and economics. These paragraphs in VML prescribes the extent of the proprietor’s exclusive rights and the limitation of the effects of a trade mark. The economical effects which these provisions have on undertakings and the market are also described in the essay. Furthermore, a theory of law and economics called Transaction cost economics (TCE) is used to explain why these provisions in VML leads to these economical consequences and to examine whether or not these provisions may be justified on the basis of this theory of law and economics.
