- Vid avgörande av frågor om bland annat vårdnad ska barnets bästa sättas i främsta rummet. Vid bedömningen av vad som är bäst för barnet är det viktigt att dess inställning klarläggs.
Barnets rätt att komma till tals stadgas i artikel 12 i Barnkonventionen och i 6 kap. 2 a § FB. Hänsyn ska tas till barnets viljeyttring med beaktande av dess ålder och mognad. Både konventionstexten och föräldrabalken saknar åldersgränser om när barnets åsikter ska beaktas. Följaktligen får ledning inhämtas från förarbeten och rättspraxis. Enligt praxis ökar barnets inflytandegrad i takt med åldern. I undantagsfall beaktas inte ett äldres barn vilja om inställningen inte har uttryckts på ett bestämt sätt.

Ändringen av konventionens rättsliga status skulle medföra att Barnkonventionen skulle ges företräde vid en konflikt mellan nationell lagstiftning och konventionen. The incorporation of the Convention into Swedish law would result in a strengthening of the rights of the child. The amendment of the Convention's legal status would mean that the Convention would be given precedence in a conflict between national legislation and the Convention.
