Erkännande av utländska barnäktenskap - i strid med barnkonventionen och dess grundläggande principer?

I Sverige genomfördes i juli 2014 en lagändring som innebar att möjligheten för personer under 18 år att få dispens för att gifta sig togs bort. I samband med ändringen begränsades även möjligheten att erkänna utländska äktenskap med svensk anknytning i de fall då någon av parterna var under 18 år vid äktenskapets ingående. Begränsningen innebär att dessa äktenskap som regel inte längre erkänns om någon av makarna hade svenskt medborgarskap eller hemvist i Sverige vid tidpunkten för äktenskapets ingående i utlandet. Vi erkänner dock utländska barnäktenskap, där någon av parterna är 15-17 år, om svensk anknytning saknas.

Syftet med denna uppsats är att utifrån en rättsdogmatisk metod granska den rättsliga regleringen av erkännande av utländska barnäktenskap med utgångspunkt i de krav som följer av barnkonventionens två grundläggande principer om icke-diskriminering samt respekt för barnets åsikter. Uppsatsen syftar på så vis till att belysa vilka rättsliga utmaningar och ställningstaganden som barnkonventionen aktualiserar i förhållande till den nuvarande regleringen av erkännande av utländska barnäktenskap.

Frågan om barnäktenskap regleras inte uttryckligen i barnkonventionen, men flera av konventionens artiklar så som principen om icke-diskriminering samt respekt för barnets åsikter kan indirekt anses skydda barn mot äktenskap. En svårighet är dock att konventionen omfattar rättigheter som dels kompletterar, dels motsäger varandra, vilket komplicerar tolkning och tillämpning av dess bestämmelser och frågan är hur ska dessa olika utgångspunkter egentligen är tänkta att förenas?

De ställningstaganden som barnkonventionen aktualiserar är på så vis komplexa, vilket leder till slutsatsen att det finns ett behov av att i det svenska lagstiftningsarbetet lyfta fram de grundläggande principer som följer av barnkonventionen samt att i allmänhet tydliggöra hur dessa ska förstås för att den nuvarande regleringen gällande erkännande av utländska barnäktenskap bättre ska kunna anpassas till de krav som konventionen uppställer. Abstract
In July 2014 new law provisions were introduced to strengthen the protection against child marriage in Sweden and as a result the possibility to grant persons under the age of 18 permission to marry was abolished. The provisions regarding recognition of foreign marriages were also further limited in cases where at least one of the parties had ties to Sweden and was under the age of 18 at the time of the marriage. As a result of the limitation these marriages are in general no longer recognized if one of the parties hade a Swedish citizenship or domicile in Sweden, when the parties entered into marriage abroad. The purpose of this thesis is to review the Swedish regulation regarding recognition of foreign child marriages based on the requirements of the Convention on the Rights of the Child (CRC) and its two general principles non-discrimination and respect for the views of the child by using a traditional legal dogmatic method. The purpose of this thesis is thus to highlight the legal challenges that the CRC poses in relation to the present Swedish regulation on recognition of foreign child marriages.

Child marriage is not specifically regulated by the CRC, but several of its articles such as the principles of non-discrimination and respect for the views of the child can indirectly be considered to protect children against marriage. Difficult is, however, the fact that the CRC embody rights that not only complement, but also contradict each other, which complicates both the interpretation and application of its articles in relation to the Swedish regulation regarding recognition of foreign child marriage.

The challenges that the CRC poses are in other words complex, which leads to the conclusion that the fundamental principles embodied in the CRC need to be not only more emphasized from a Swedish legislative work perspective, but in general also better clarified in order for the regulation regarding recognition of foreign child marriage to better adapt to the requirements of the CRC.
