- I 29 kap. 6 § BrB regleras förutsättningarna för påföljdseftergift. Bestämmelsen har tre kumulativa rekvisit: att den tilltalade har funnits skyldig till brottet, att det finns förmildrande omständigheter samt att en påföljd framstår som uppenbart oskälig. De förmildrande omständigheterna i 29 kap. 5 § BrB, som påföljdseftergift grundas på, kallas ”billighetsskäl” och hänför sig till omständigheter utanför gärningen.
Uppsatsen har till syfte att utreda när bestämmelsen i 29 kap. 6 § BrB är tillämplig. Syftet uppnås genom att analysera förarbeten, rättspraxis och doktrin utifrån en rättsdogmatisk metod. Uppsatsen fokuserar på kopplingen till billighetsskälen i 29 kap. 5 § BrB samt söker finna en definition av vad som är uppenbart... Framställningen visar att eftergiften kan meddelas både utifrån ett enskilt billighetsskäl såväl som utifrån helhetsbilden och det krävs således inte att rätten måste konstatera att ett enskilt billighetsskäl ensamt medför att påföljden framstår som uppenbart oskälig. Inga egentliga hinder finns heller för att meddela påföljdseftergift även vid grova brott. Vidare kommer uppsatsen fram till att straffvärdet är avgörande för tillämpningen av påföljdseftergift. Ju högre straffvärdet är för det aktuella brottet, desto starkare förmildrande skäl ska finnas för att meddela påföljdseftergift. (Less) - Abstract
- The prerequisites for remission of sanctions are regulated in chapter 29, 6 § of the Swedish penal code (BrB). The regulation has three cumulative prerequisites: that the defendant has been found guilty, that there are mitigating circumstances and that a sanction, with regard to these circumstances, is obviously unreasonable. The mitigating circumstances, that are regulated in chapter 29, 5 § BrB, are the ground of which the court must base the verdict. They refer to circumstances not related to the deed itself.
The thesis’ purpose is to investigate when the regulation in chapter 29, 6 § BrB is applicable. The purpose is fulfilled by analyzing the legislative history, established practice and doctrine through a legal dogmatic method.... The thesis focuses on the connection between the mitigating circumstances in chapter 29, 5 § BrB and remission of sanction in chapter 29, 6 § BrB. The thesis also try to define what is needed for a sanction to appear obviously unreasonable.
The presentation shows that the remission can be applicable both in situations where only one mitigating circumstance is at hand as well as with regard to the overall picture. It is therefore not necessary for the court to ascertain that a single circumstance alone makes a sanction obviously unreasonable. Nor does any obstacles exists for the court to find remission of sanction applicable even in cases where a serious crime is at hand. The essay will furthermore show that the penal value is essential for the application of a remission of sanction. The higher the penal value is for the crime, the stronger the reasons must be to find a remission of sanction pertinent. (Less)
