- Under senare år har det kommit ett par avgöranden i Sverige angående fildelningsbrott varav flera har lett till höga utdömda skadestånd på tämligen svaga grunder. Dessa svaga grunder som består av främst antaganden och uppskattningar utan uppbackande fakta leder till att man måste ifrågasätta huruvida domstolarna faktiskt dömer enligt de principer som lagstiftaren har stiftat eller ifall de självmant väljer att bortse ifrån dessa.
För att undersöka och granska detta har enbart skadeståndsfrågorna inom fildelningsbrott berörts för att på så sätt kunna lägga fokus på de argument som lagts fram av upphovsmännen för att stödja sina påstådda skador. Efter en granskning av både gällande rätt och domstolarnas inställning till upphovsmännens... Dessa svaga grunder som består av främst antaganden och uppskattningar utan uppbackande fakta leder till att man måste ifrågasätta huruvida domstolarna faktiskt dömer enligt de principer som lagstiftaren har stiftat eller ifall de självmant väljer att bortse ifrån dessa.
För att undersöka och granska detta har enbart skadeståndsfrågorna inom fildelningsbrott berörts för att på så sätt kunna lägga fokus på de argument som lagts fram av upphovsmännen för att stödja sina påstådda skador. Efter en granskning av både gällande rätt och domstolarnas inställning till upphovsmännens argument blir det tyvärr tydligt att domstolarna inte haft den kritiska inställningen till upphovsmännens påstådda skador som de borde. - During the last years there’ve been a few cases in Swedish court regarding illegal file sharing and several of these have resulted in high damages and the claims are mostly based on assumptions and estimations without any real facts to support it. With that in consideration, you have to ask the question whether the court’s rulings are based on the legislator’s intentions or if they voluntarily disregard them.
To investigate and review this, the only aspects that are being touched upon are compensation within illegal file sharing. It’s done this way so that the main focus can be on the arguments from the copyrights owners for their alleged damages.
