- Abstract
- When selling property entails a variety of duties, both for the seller for the buyer. One of these duties of the seller is duty to provide information. For personal property is the duty of legislation laid dawn in law. But for real estate, it is only indirectly regulated within judicial error and error of right of disposition of a property unit. The duty to provide information of physical errors in real estate is not laid dawn in law, although it seems such a duty has been developed in precedents. One reason for this development of precedents can be that it is from an economic perspective mainly desirable with a certain duty to provide information as it reduces transaction costs, which leads to more favorable transactions into being and... - Vid försäljning av egendom uppkommer en rad olika skyldigheter, både för säljaren som för köparen. En av dessa skyldigheter för säljaren är upplysningsplikt. Gällande lös egendom finns denna plikt lagreglerat på området. Men för fast egendom är det endast indirekt reglerat inom rättsliga fel och rådighetsfel. Gällande faktiska fel i fast egendom finns ingen lagreglerad upplysningsplikt, trots verkar en sådan plikt har utvecklats i praxis. En anledning till denna praxisutveckling kan vara att det är ur ett ekonomiskt perspektiv huvudsakligen önskvärt med en viss upplysningsplikt då det minskar transaktionskostnaderna, därmed kommer fler gynnande transaktioner till stånd och i och med det ökar samhällsekonomin.
