Abstract
The Swedish courts offer court-annexed mediation as an alternative to litigation or court-annexed conciliation. On the Swedish National Courts Administration’s website, there is a list available of Swedish mediators available for court-annexed mediation that includes lawyers, judges and social workers.
From an international perspective, there are several institutes that offer accreditation for mediators, for example the Centre of Dispute Resolution in London, Great Britain. Some Swedish mediators have received accreditation from London, which gives them knowledge over mediation techniques and mediation models. On an international level, the accreditation services contribute with a high standard for mediators.

The Swedish courts offer court-annexed mediation as an alternative to litigation or court-annexed conciliation. On the Swedish National Courts Administration’s website, there is a list available of Swedish mediators available for court-annexed mediation that includes lawyers, judges and social workers.
From an international perspective, there are several institutes that offer accreditation for mediators, for example the Centre of Dispute Resolution in London, Great Britain. Some Swedish mediators have received accreditation from London, which gives them knowledge over mediation techniques and mediation models. On an international level, the accreditation services contribute with a high standard for mediators.

This thesis examines how court-annexed mediators in Sweden do not have access to a Swedish accreditation system. Only a small part of the mediators has taken the responsibility to become accredited mediators themselves. The Swedish system can be compared to the Australian national accreditation system that has provided the Australian private dispute resolution market with mediators of high standard.
By legal dogmatic method and comparative method, this thesis examines the benefits and risks with a Swedish national accreditation system.
It is impossible to tell how an accreditation can contribute to the dispute resolution market since there is no official Swedish statistics over the current mediation market, but there are at least several benefits with an accreditation that a mediator can use in order to improve the standards of mediation, for example reduce the risks of power imbalances between parties.
The conclusion of this thesis is that an accreditation system probably would have improved the court-annexed mediation standard in Sweden, which would lead to an improved use of mediation. (Less)

Särskild medling erbjuds idag av Sveriges domstolar som ett alternativ till en domstolsprocess eller förlikningsprocess. Särskilda medlare i Sverige består idag utav en blandning av advokater, domare och socionomer.
Internationellt sätt finns det erkända institut som erbjuder ackreditering för medlare, däribland Centre of Dispute Resolution i London, Storbritannien. Medlare från Sverige och hela världen får därifrån ackreditering som medlare, vilket ger dem kunskap om olika medlingsmetoder och tekniker. Uppsatsen går igenom hur särskilda medlare i Sverige inte har tillgång till något svenskt ackrediteringssystem och att det enbart är en liten del av medlarna som själva tagit ansvar för sin ackreditering. Detta jämförs med det frivilliga ackrediteringssystem för medlare som finns i Australien, som även skapat en betydande efterfrågan från den privata marknaden på ackrediterade medlare.

Genom en rättsdogmatisk och komparativ studie läggs fördelar och nackdelar med ett svenskt ackrediteringssystem fram.
Det går inte att förutsäga huruvida ett ackrediteringssystem hade förbättrat särskild medling i svensk rätt, delvis beroende på att det först måste finnas ett beslut om vem som ansvarar för ackrediteringen; den privata marknaden eller staten.
Det finns dock flera fördelar med en ackreditering som hade hjälpt medlare att tillgodose sina klienter med de specifika fördelar som en medlingsprocess kan innebära och som annars riskerar att gå förlorad på grund av kunskapsbrist.
Slutsatsen blir därför att ett ackrediteringssystem behövs och att detta troligtvis hade ökat efterfrågan på den svenska marknaden för särskild medling. (Less)
