- Mot bakgrund av att det inte ännu finns någon fungerande gemensam valuta inom EU kvarstår valutakursrisker som ett hinder för handel inom den inre marknaden. Dessa hinder har bland andra EUD angripit med stöd av fördragsfriheterna. I uppsatsen behandlas inledningsvis frågan om användandet av utländsk valuta kan utgöra det gränsöverskridande moment som gör EU-rätten tillämplig och därefter hur den jämförbara situationen konstrueras i sådana fall. Med hänsyn till att EUD har en rättspolitisk agenda att stärka unionen menar jag att användandet av utländsk valuta utgör ett gränsöverskridande moment som möjliggör en tillämpning av EU-rätten. I uppsatsen behandlas inledningsvis frågan om användandet av utländsk valuta kan utgöra det gränsöverskridande moment som gör EU-rätten tillämplig och därefter hur den jämförbara situationen konstrueras i sådana fall. Med hänsyn till att EUD har en rättspolitisk agenda att stärka unionen menar jag att användandet av utländsk valuta utgör ett gränsöverskridande moment som möjliggör en tillämpning av EU-rätten. Den jämförbara situationen konstrueras i dessa mål på sedvanligt vis, genom att den gränsöverskridande situationen sätts i relation till en rent intern situation.
I Holding AB har HFD tagit ställning till de ovanstående EU-rättsliga problemen utifrån intern svensk rätt. HFD:s tillämpning av EU-rätten analyseras kritiskt och särskilt fokus ligger på frågan om Holding AB kan anses ha lidit en verklig förlust. Med hänsyn till att Holding AB:s förlust uppkommer först vid beräkningen av det skattepliktiga resultatet och inte i bokföringen, samt att förlusten inte påverkar företagets förmåga att betala skatt anser jag att förlusten inte bör anses verklig. Amongst others, the CJEU has addressed these obstacles through an application of the four freedoms. The initial question treated in this thesis is if the use of foreign currency is a cross-border element enabling the application of EU law, and if so, how is the comparable situation constructed? Considering that the CJEU has a political agenda that aims at strengthening the EU, the essay concludes that the use of foreign currency is a cross-border element enabling the application of EU law. - Since there still is no common currency within the EU, exchange rates still risk acting as an obstacle for trade on the internal market. Amongst others, the CJEU has addressed these obstacles through an application of the four freedoms. The initial question treated in this thesis is if the use of foreign currency is a cross-border element enabling the application of EU law, and if so, how is the comparable situation constructed? Considering that the CJEU has a political agenda that aims at strengthening the EU, the essay concludes that the use of foreign currency is a cross-border element enabling the application of EU law. The comparable situation is, according to present case law, constructed through the conventional method. It means that the cross-border situation is compared to a domestic situation.
The Swedish Supreme Administrative Court had to deal with the afore-mentioned questions relating to EU law in the Holding AB case. The judgement is analysed from a critical perspective and with special focus on whether Holding’s loss can be considered a real economic loss. Due to the fact that Holding’s loss first appears in the calculation of the taxable income and because the claimed loss does not affect the company’s ability to pay taxes, the essay concludes that the loss cannot be considered to be a real economic loss.
