Min uppsats syftar till att analysera inskränkningar i varumärkesrättslig ensamrätt, där import av de varumärkesskyddade varorna är tillåten mellan medlemsstater utan att rättsinnehavarens tillstånd anskaffas. Den varumärkesrättsliga ensamrätten konsumeras när rättsinnehavaren för ut varan på marknaden själv eller med innehavarens samtycke. En så kallad regional konsumt-ion har vuxit fram genom EU-domstolens praxis, bl.a. genom Silhouette-fallet, och omfattar numera alla länder inom EU.

Min uppsats syftar till att analysera inskränkningar i varumärkesrättslig ensamrätt, där import av de varumärkesskyddade varorna är tillåten mellan medlemsstater utan att rättsinnehavarens tillstånd anskaffas. Den varumärkesrättsliga ensamrätten konsumeras när rättsinnehavaren för ut varan på marknaden själv eller med innehavarens samtycke. En så kallad regional konsumt-ion har vuxit fram genom EU-domstolens praxis, bl.a. genom Silhouette-fallet, och omfattar numera alla länder inom EU.

Konsumtionsprincipen innehåller rekvisit som ska vara uppfyllda, i syfte att kunna begränsa rättsinnehavarens ensamrätt till den skyddade produkten. Uttrycket förs ut på marknaden är centralt vid tillämpning av konsumtionsregeln. Detta torde ske när en varumärkesskyddad vara finns tillgänglig för slutkunden och därmed har lämnat rättsinnehavarens hand. Det räck-er således inte att varan marknadsförs under kontroll av rättsinnehavaren eller finns tillgänglig som en testartikel eller exemplar i butiker. Det krävs också ett samtycke, där EU-domstolen har anlagt en restriktiv tolkning, som innebär att samtycke från rättsinnehavaren ska vara klart och tydligt demonstrerat.

EU:s grundläggande principer om fri rörlighet för varor, en sund och effektiv konkurrens samt avskaffandet av handelshinder är tanken bakom ett ökat samarbete mellan medlemsstater. Inom ramen för en fri varucirkulation samt en sund konkurrens inom EU, har parallellimport en positivställning på marknaden, medan en sådan begränsning i ensamrätten för varumärkes-rättsinnehavaren anses vara en oönskad företeelse.

Bevisbördeproblematiken i parallellimportfallen spelar en viktig roll för både varumärkesrätt-sinnehavaren och parallellimportören, eftersom det kan styra deras framtida ageranden. EU-domstolen har i sin praxis kommit fram till att bevisbördan ska fördelas mellan parterna, ef-tersom det bäst stämmer överens med VmDir samt konsumtionsprincipens syfte. (Less)
Abstract
My thesis aims to analyze the restrictions of trademark proprietor’s exclusive right, where imports of the trademarked goods are permitted between Member States without the authori-zation of the trademark proprietor. A so-called Community exhaustion has emerged through the European Court of Justice, inter alia, Silhouette case and cover all countries in the EU. EU Court's interpretation confirms the Community exhaustion, which in turn reinforces the paral-lel importer opportunities for imports in the EU. Decisions are also the basis for the Trade Mark Directive, which in turn leads to further harmonization in this area.

My thesis aims to analyze the restrictions of trademark proprietor’s exclusive right, where imports of the trademarked goods are permitted between Member States without the authori-zation of the trademark proprietor. A so-called Community exhaustion has emerged through the European Court of Justice, inter alia, Silhouette case and cover all countries in the EU. EU Court's interpretation confirms the Community exhaustion, which in turn reinforces the paral-lel importer opportunities for imports in the EU. Decisions are also the basis for the Trade Mark Directive, which in turn leads to further harmonization in this area.

The principle of exhaustion contain conditions which must be fulfiled in order to be able to limit the trademark proprietor’s exclusive right. The phrase put on the market is central to the application of the exhaustion rule. This should be done when a trademarked products is avai-lable for the customer and thus has left the holder's hand. The second requirement is consent, where the European Court of Justice have adopted a restrictive interpretation suggesting that the consent of the right holder shall be clearly demonstrated. Thus, left little room for an im-plied consent.

The basic EU principles of free movement of goods and effective competition are the idea behind the increased cooperation between the Member States. Within the framework of sound cone competition within the EU, it has thus been a positive position for parallel imports, while the trademark proprietor consider such a restriction to the exclusive right to be an undesirable phenomenon.

The burden of proof play an important role for both the trademark proprietor and the parallel trader, because it can control their future actions. The European Court of Justice has in its practice has concluded that the burden of proof should be divided between the parties, as it best fits the purpose of the exhaustion. (Less)
