- Sverige var utformat som ett industrisamhälle under 1900-talet och därmed var även lagen utformad efter det samhället. Idag är det istället ett informationssamhälle med komplexa organisationer och goda kommunikationsmöjligheter. Förändringen av samhället gör att LAS från 1982 med tillhörande ortsbegrepp väcker diskussionen om ortsbegreppet är i behov av att förändras eller ersättas.
Kandidatuppsatsen undersöker ortsbegreppet i LAS innebörd och utveckling i den svenska arbetsrätten och arbetsmarknad. Ortsbegreppet regleras i 22 § LAS om turordningsreglerna. Kandidatuppsatsen undersöker ortsbegreppet i LAS innebörd och utveckling i den svenska arbetsrätten och arbetsmarknad. Ortsbegreppet regleras i 22 § LAS om turordningsreglerna. Syftet med kandidatuppsatsen är att undersöka om ortsbegreppet i LAS utvecklas genom tiden allteftersom arbetsmarknaden förändras. I uppsatsen undersöks vilka rättsfaktum som är avgörande för att klargöra ortsbegreppet. Vilket geografiskt område ska en turordningskrets täcka? Finns det en organisatorisk faktor? Vad innebär ”ort”? Relevant rättspraxis tillsammans med doktrin, förarbeten och utredningar i uppsatsen ska klargöra ortsbegreppet.
Uppsatsen har även i syfte att undersöka och belysa om det är möjligt att applicera ortsbegreppet på vad en skälig omplacering anses vara vid en arbetsgivares omplaceringsskyldighet i 7§ LAS. Hur långt kan ska en omplacering sträcka sig i en organisations verksamhet för att anses skälig? Kan ortsbegreppet fungera som en gräns för en skälig omplacering? Dessa frågor diskuteras och analyseras genom rättspraxis, doktrin och förarbeten. (Less) - Abstract

The district concept is a part of 22§ in the swedish employment protection act: LAS, regarding the priority rules of employees concering layoffs. The purpose of the thesis is to examine if the district concept develops through the years as the labor market changes. What geographic area shall the priority rules consists of? Is there an organizational factor in the district concept? What is a ”district” in 22 § LAS? These questions will be answered by analyzing relevant cases, doctrine prepatory work, investigations and the collective agreements of the public sector concerning the district concept
The purpose of the essay is also to analyze and discuss if it is possible to apply the district concept to what a reasonable repositioning of an employee is. Regarding an employers obligation to investigate repositioning of employees in 7§ LAS. How far can a repositioning stretch to be regarded as reasonable? Can the district concept work as boundary for a reasonable repositioning? These questions are being discussed and answered by using relevant cases, doctrine, prepatory work and investigations (Less)
