- Äganderätten vilar på ensamrätten att förfoga över sitt verk. Upphovsrätten ska skydda rättighetshavare och beivra intrång. Upphovsrättsintrång är ett angivelsebrott, vilket innebär att behörig rättighetshavare som huvudregel måste ange brottet till åtal. Denna uppsats behandlar intrång i upphovsrätten utifrån ett straffrättsligt perspektiv. Som titeln antyder fokuseras främst på upphovsmannen som främste rättighetshavare, men för sammanhanget belyses också andra rättighetshavare och olika upphovsrättsliga organisationers betydelse. I undersökningen behandlas vem som innehar vilka rättigheter och vem som är s.k. rättighetshavare med talerätt och hur talerätten påverkas av överlåtelser som är vanliga inom svensk musikindustri.

Viktiga frågor för åtalsprövningen analyseras, liksom vad som krävs för att åklagare ska ha rätt, eller vara tvingad till, att åtala oberoende av anmälan eller målsägandes angivelse om åtal är påkallat ur allmän synpunkt. Undersökningens slutsatser belyser rättsregeln i lagförarbeten kontra rättstillämpning. Vidare undersöks tillämpningen, främst avseende brottskoden för upphovsrättsbrott som inte avser fildelning, och förändringar i rättsvårdande myndigheters organisering och utredningsarbete.
53 § upphovsrättslagen omfattar de intrång som uppstår då en inträngare vidtar åtgärder, inom området för upphovsmannens ensamrätt, utan att inhämta upphovsmannens tillstånd till de ekonomiska och ideella rättigheterna.
Andra relevanta slutsatser diskuteras även utifrån ett upphovsmannaperspektiv, samt hur upphovsrättslagstiftningen, och rättstillämpningen påverkar kreativiteten och skapandet. (Less) - Abstract
- Ownership rests on the exclusive rights to dispose of one’s own work. Copyright law intends to protect right holders, and to prosecute cases of infringement. Copyright infringement is an indication crime, meaning the right holder must define the crime to be prosecuted. This thesis addresses copyright infringement from a criminal perspective. As the title suggest, the thesis focuses on the copyright holder as the utmost right holder. In context, however, the significance of other copyright holders and organizations are also discussed.
This study also addresses copyright holders with right of speech, and how this right is affected by transfers of such rights, common in the Swedish music industry.

In addition, enforcement of copyright infringement unrelated to file sharing, and the investigation by - as well as reorganization of - law enforcement authorities are also primarily discussed.
53 § The Swedish copyright law (1960:729) regulates infringement, i.e. when a legal person commits an unauthorized act, irrespective of non-profitable or economical rights from the copyright holder. Other relevant conclusions are also discussed, from a copyright holder’s perspective, and, how the application of the copyright law affects the creativity of arts. (Less)
