Vad är det som gör att man begår ett brott? Vad är det för slags person som begår ett brott? Kriminella personer har alltid varit ett intresse för forskning och allmänheten. Det finns förutfattade meningar om hur en kriminell person ser ut eller beter sig. Samtidigt finns det en lika tydlig bild av hur en kvinna eller man ska se ut eller bete sig. En kriminell kvinna går emot alla förväntningar medan en kriminell man inte gör det. Den här uppsatsen har undersökt hur domstolen bedömer kriminella kvinnor som har begått allvarliga våldsbrott.

Vad är det som gör att man begår ett brott? Vad är det för slags person som begår ett brott? Kriminella personer har alltid varit ett intresse för forskning och allmänheten. Det finns förutfattade meningar om hur en kriminell person ser ut eller beter sig. Samtidigt finns det en lika tydlig bild av hur en kvinna eller man ska se ut eller bete sig. En kriminell kvinna går emot alla förväntningar medan en kriminell man inte gör det. Den här uppsatsen har undersökt hur domstolen bedömer kriminella kvinnor som har begått allvarliga våldsbrott.

Syftet med uppsatsen var att undersöka hur kriminella kvinnor bedöms av domstol jämfört med varandra beroende på hur väl man uppfyller rollen av att vara kvinna. För att kunna göra detta har en litteraturstudie och en brottmålsanalys genomförts. Genom uppsatsen har ett genusrättsperspektiv använts för att kunna belysa att det finns en skillnad mellan könen samt en feministisk analys för att lyfta skillnaden genom den kriminella kvinnans erfarenhet. Vidare har två teser använts för att se skillnaden kvinnor emellan, om de antingen behandlas mildare genom ridderlighetstesen eller om de får ett hårdare straff genom onda kvinnan-tesen.

Genom litteraturstudien undersöktes olika stereotypiska egenskaper som sedan användes vid brottmålsanalysen. Sådant som var ”typiskt” manligt eller kvinnligt noterades vid domstolens bedömning. Om en kvinna sedan tidigare hade upplevt våld i nära relation bedömdes hon uppleva ”the battered woman syndrom” som tillskrev henne vissa egenskaper som sedan var svåra att bli av med. Det fanns en tendens att bedöma kvinnor som offer baserat på deras livssituation eller andra omständigheter. Om hon hade ”the battered woman syndrom” blev det en ytterligare faktor som tog bort en del av hennes skuld till gärningen. Detta har sedan visat sig i brottmålsanalysen, som är baserad på elva stycken brottmål. Det fanns en skillnad vid bedömning av kriminella gärningspersoner beroende på deras kön. Det finns en benägenhet att försöka förklara den kvinnliga gärningspersonens handling jämfört med den manlige där man snarare accepterar vad det är som har hänt. Dock behöver inte detta betyda att det inte finns andra rättsfall som visar på en annorlunda rättstillämpning, eftersom studien bara har undersökt elva brottmål. (Less)

There is a preconceived notion on how an offender should look or act like. At the same time, being a woman or a man comes with equal preconceptions. However, a female offender goes against all expectations of how an offender should act and how a woman should act. What does it take for a person to commit a crime? What kind of person commits a crime? Offenders have always been interesting for both research and the society. There is a preconceived notion on how an offender should look or act like. At the same time, being a woman or a man comes with equal preconceptions. However, a female offender goes against all expectations of how an offender should act and how a woman should act. This essay will examine how the court assesses a female offender that has committed serious acts of violence.

The purpose of this essay is to examine how offender women are assessed in court compared to other women when it comes to fulfilling the role of being a woman. To do this, a literature study and a offender case analysis have been conducted. Through the essay, a gender perspective has been used to illustrate that there is a difference between the sexes and a feminist analysis to emphasize the difference through the offender woman's experience. In addition, two theses will be applied to explain the difference between women and men. Either if women receive gentler punishment by chivalry theses or if the punishment is harsher by the evil woman theses.

The literature study examined various stereotypical attributes. These attributes were then used in the offender case analysis. Those traits that were “typical” male or female was noticeable in the Court’s assessment. If a woman previously had experienced domestic violence, she was deemed to have “the battered woman syndrome” which attributes her some characteristics that are then difficult to get rid of. There was a tendency to assess women as victims based on their life situations or other circumstances. If she had “the battered woman syndrome”, it became an additional factor that removed some of her guilt to the act. As a result, in the offender case analysis which covered 11 cases, it showed that there was a difference in the assessment of offender offenders depending on their gender. There was a tendency to try to explain the act of the female offender compared with the male where one rather accepts what has happened. However, the case analysis was based on a small amount of cases and it does not mean that there are no other cases showing a different assessment. (Less)
