Oaktsam våldtäkt – också ett övergrepp? - En analys av 2014 års sexualbrottskommittés förslag om att införa ett oaktsamhetsansvar för våldtäkt

För att en person ska kunna straffas för våldtäkt enligt svensk rätt krävs det att denne har haft uppsåt till gärningen. Det innebär att personen måste ha varit medveten om alla de omständigheter som medfört att gärningen är att betrakta som en våldtäkt, exempelvis att den utsatte sov eller tvingades till de sexuella handlingarna. Detta krav på uppsåt har i ett flertal fall, där den tilltalade frikänts enbart på grund av bristande uppsåt, lett till protester både från allmänheten och från personer inom rättsvetenskapen.

Detta krav på uppsåt har i ett flertal fall, där den tilltalade frikänts enbart på grund av bristande uppsåt, lett till protester både från allmänheten och från personer inom rättsvetenskapen.

Med anledning av den debatt som förekommit tillsattes år 2014 en utredningskommitté, 2014 års sexualbrottskommitté, som bland annat fick i uppdrag att överväga möjligheten att införa ett oaktsamhetsansvar för våldtäkt. Resultatet blev en utredning som presenterades i oktober 2016, som innehåller ett förslag om att genom en särskild bestämmelse kriminalisera oaktsam våldtäkt. Förslaget innebär att det ska räcka att gärningsmannen misstänkte eller verkligen borde ha misstänkt att det förelåg sådana omständigheter som medför att gärningen objektivt sett är att betrakta som en våldtäkt, exempelvis att den andra personen sov.

Syftet med följande framställning är att utreda och analysera förslaget om ett oaktsamhetsansvar för våldtäkt, särskilt med utgångspunkt i brottsoffers behov av upprättelse och principen om att klandervärda handlingar ska kriminaliseras. Uppsatsen utreder om dessa intressen kan tillgodoses genom förslaget, för att på så sätt svara på frågan om bestämmelsen bör införas i svensk rätt. Särskild vikt läggs vid det genomslag bestämmelsen kan tänkas få i praktiken. För att utreda detta genomförs bland annat en rättsfallsanalys där bestämmelsen appliceras på omständigheterna i ett antal rättsfall där den tilltalade har frikänts från våldtäkt på grund av bristande uppsåt. Resultatet av tillämpningen i rättsfallsanalysen är att de tilltalade i en knapp majoritet av fallen har varit grovt oaktsamma. Utifrån detta resultatet förs ett resonemang kring hur bestämmelsen kan komma att tillämpas i olika typer av situationer. Bedömningen är att den sannolikt kommer kunna leda till fällande domar i flera typer av situationer där den nuvarande regleringen inte gör det.

Den föreslagna bestämmelsen kommer därför troligtvis medföra att klandervärda handlingar i större utsträckning än tidigare kan lagföras med stöd av bestämmelsen. Bestämmelsen kommer sannolikt även kunna bidra till ett ökat skydd för brottsoffer, där upprättelse och ett erkännande från samhället ges. Den slutsats som dras i uppsatsens avslutande del är att bestämmelsen bör införas i svensk rätt, men att det alltjämt kommer finnas klandervärda sexuella handlingar som inte omfattas av bestämmelsen. In order to be convicted for rape under Swedish criminal law, the defendant must have had an intent to commit the crime. This means that the defendant must have been aware of all the circumstances that objectively make it a rape, for example that the victim slept or were forced to the sexual act. This requirement of intent has in several cases, where the defendant has been acquitted based solely on the lack of intent, led to protests among both legal theorists and the public.

This requirement of intent has in several cases, where the defendant has been acquitted based solely on the lack of intent, led to protests among both legal theorists and the public.

The proposal requires gross negligence, and means that it is enough if the offender suspects or really should have suspected that the act objectively constituted a rape. The offender could for example be held liable if he or she suspected that the victim slept and thereby were in an especially exposed situation.

The purpose of this thesis is to examine and analyse the proposal of a negligence rape offense, especially in consideration of the victims' need for redress, and the principle that reprehensible acts should be criminalised. The idea is to examine whether these interests can be satisfied by the legislative proposal, thus responding to the question of whether the provision should be introduced in Swedish law. For this question, particular emphasis is put on the possible effect that the proposal may have in practice. In order to examine what practical function the provision may have, the thesis contains a court cases analysis. Here, the proposed provision is applied to the circumstances of a number of cases in which the defendant has been found not guilty of rape, based on a lack of intent. The outcome of the court cases analysis is that the defendant in the majority of cases is considered to be grossly negligent. Based on this, I analyse how the provision can be applied in different types of situations. The conclusion is that the legislative proposal of a negligent form of rape is likely to lead to an increased number of convictions.

Therefore, an enactment of the proposed provision will probably mean that reprehensible acts can be enforced to a greater extent than before. The proposed provision will also be able to contribute to an increased protection for victims of crime, satisfying their need for redress and giving them a recognition from society. The final conclusion of the essay is that the proposed provision should be introduced into Swedish law, but that there still will exist reprehensible sexual acts that are not covered by the provision.
