Ord mot ord, fria eller fälla? - Om bevisvärdering i våldtäktsmål

I våldtäktsmål är det inte ovanligt att den enda bevisningen utgörs av målsägandens utsaga. Avsaknad av övrig bevisning har kommit att skapa ovisshet angående huruvida målsägandens utsaga ensamt kan anses vara tillräcklig för att uppnå beviskravet, eller om det även krävs någon form av stödbevisning. Ett sådant krav på stödbevisning skulle dock kunna hamna i konflikt med bevisrättsliga principer. Vidare kan oklarheter för hur kravet tolkas få konsekvenser för rättssäkerheten beroende på hur tillämpningen ser ut i praktiken. Syftet med uppsatsen är därför att undersöka om bevisvärderingen i våldtäktsmål är rättssäker.

Ett sådant krav på stödbevisning skulle dock kunna hamna i konflikt med bevisrättsliga principer. Vidare kan oklarheter för hur kravet tolkas få konsekvenser för rättssäkerheten beroende på hur tillämpningen ser ut i praktiken. Syftet med uppsatsen är därför att undersöka om bevisvärderingen i våldtäktsmål är rättssäker.

En av grundprinciperna inom svensk bevisrätt är att det råder fri bevisvärdering. Principen innebär att domstolarna inte är bundna av några rättsregler när de ska värdera den av parterna åberopade bevisningen. I teorin kan det, i ord mot ord-situationer, vara tillräckligt med målsägandens utsaga för att beviskravet ska anses uppfyllt. Det är emellertid inte säkert att den praktiska tillämpningen förhåller sig på det sättet, då det i underrätterna gjorts olika tolkningar av Högsta domstolens prejudikat i frågan.

I uppsatsen har ett flertal domar analyserats, i vilka viss inkonsekvens påvisats vad gäller bevisvärderingen i våldtäktsmål. Det tycks föreligga oenighet mellan domstolarna rörande huruvida det faktiskt uppställs ett krav på stödbevisning eller inte. De olika tolkningarna baseras på de prejudikat avseende bevisvärdering i våldtäktsmål som meddelats av Högsta domstolen. En del domar utelämnar viktiga ställningstaganden för bevisvärderingen i domskälen vilket blir problematiskt för förutsebarheten. Framställningen visar att bevisvärderingen i våldtäktsmål i många avseenden brister i rättssäkerhetshänseende. För mer enhetliga bedömningar och en minimering av risken för subjektiva inslag i bevisvärderingen är det önskvärt att Högsta domstolen meddelar nya prejudikat som reder ut de oklarheter som råder, och som dessutom inte står i strid med de bevisrättsliga principer som råder i svensk processrätt. In criminal cases concerning rape, it is not uncommon that evidence only consists of the victim's testimony. The lack of other evidence has led to the question whether the injured party’s testimony alone can be considered sufficient to achieve the evidentiary requirement, or if any support evidence is required. However, such a requirement of support evidence could be in conflict with fundamental legal principles regarding evidence. Furthermore, the ambiguities about the interpretation and whether there is a demand for support evidence or not may have implications for the rule of law depending on the adjudication in practice. In criminal cases concerning rape, it is not uncommon that evidence only consists of the victim's testimony. The lack of other evidence has led to the question whether the injured party’s testimony alone can be considered sufficient to achieve the evidentiary requirement, or if any support evidence is required. However, such a requirement of support evidence could be in conflict with fundamental legal principles regarding evidence. Furthermore, the ambiguities about the interpretation and whether there is a demand for support evidence or not may have implications for the rule of law depending on the adjudication in practice. According to one of the fundamental principles of proof in Swedish procedural code, the assessment of evidence is free. This principle implies that the courts are not bound by any legal rules or methods when assessing the evidence invoked by the parties. It is theoretically possible to fulfill the burden of proof solely on the basis of the injured party’s testimony. Even so, there is no guarantee that courts of first instance applies this principle since they made different interpretations of the Supreme Court's precedent on the matter.

In this paper, a number of judgments has been analyzed, in which some inconsistencies have been demonstrated regarding the evaluation of evidence in cases concerning rape. There appears to be disagreement among the courts as to whether or not there exists a requirement for proof of support besides the victim’s testimony. The different interpretations are based on the precedent from the Supreme Court concerning the evidence assessment in cases concerning rape. Some findings omit important standpoints regarding the assessment of evidence, which is problematic from a point of view of predictability. This essay shows that the assessment of evidence in cases concerning rape sometimes is in violation to principles of legal certainty. For more uniform assessments and minimizing the risk of subjective elements in the assessment of evidence, it is necessary that the Supreme Court announce new precedents that clears out the uncertainties that exist and which corresponds with the fundamental legal principles regarding evidence in the Swedish law.
