- I denna uppsats undersöks tolkningen i asylprocessen ur ett rättssäkerhetsperspektiv. Detta görs utifrån den påverkan brister i tolkningen kan ha på den sökandes uppfattade trovärdighet. Att sökandens bevisning (i form av asylberättelsen) framstår som inte trovärdig på grund av brister i tolkningen är inget som är förutsägbart för sökanden med hjälp av rättsreglerna och på detta sätt kan brister i tolkningen påverka rättssäkerheten. - I denna uppsats undersöks tolkningen i asylprocessen ur ett rättssäkerhetsperspektiv. Detta görs utifrån den påverkan brister i tolkningen kan ha på den sökandes uppfattade trovärdighet. Att sökandens bevisning (i form av asylberättelsen) framstår som inte trovärdig på grund av brister i tolkningen är inget som är förutsägbart för sökanden med hjälp av rättsreglerna och på detta sätt kan brister i tolkningen påverka rättssäkerheten. Denna uppsats undersöker dels vilka regler som finns kring tolkningen i asylprocessen för att öka kvaliteten på tolkningen och därmed öka rättssäkerheten, dels möjligheterna att överklaga med åberopande av brister i tolkningen som förklaring till vad som ansetts vara bristande trovärdighet. Vid undersökandet av möjligheterna att överklaga undersöks dels Migrationsöverdomstolens praxis, dels görs en mindre undersökning av migrationsdomstolens domar från januari 2015 till mars 2017. Resultaten visar att kvaliteten på tolkningen inte är särskilt strikt reglerad samt att åberopande av brister i tolkningen som förklaring till vad som ansetts vara bristande trovärdighet i ett överklagande inte alltid prövas. - This essay examines interpreting in the asylum procedure from the perspective of legal certainty, in respect of the influence interpreting deficiencies can have for the credibility assessment of the applicant. That the evidence of the applicant (in shape of the applicant’s statements) is considered not credible due to interpreting deficiencies is not predictable to the applicant from the law and this is how interpreting deficiencies can influence certainty of law. This essay examines what rules exist to guarantee the quality of the interpreting in the asylum process and thereby increase the certainty of law. The investigation of the possibilities to appeal contains precedents from Migrationsöverdomstolen (final instance for migration cases) and a smaller examination of cases from migrationsdomstolarna (second instance for migration cases) from January 2015 to March 2017. The results show that the quality of the interpreting is not very strictly regulated and that referring to interpreting deficiencies as explanation for what has been considered lacks in credibility is not always examined by the courts.
