Barnets bästa - vid vårdnadstvister med olovligt bortförande

Under de senaste åren har antalet vårdnadstvister som avgjorts i domstol ökat markant i Sverige. Samtidigt har Sverige blivit ett mer mångkulturellt samhälle med en ökad arbetskraftsinvandring och kontinuerliga flykting- strömmar. I dagsläget har fler familjer än någonsin anknytning till utlandet vilket förstärker vissa problem inom familjerätten. Flera barn blir varje år olovligen bortförda ifrån en av sina föräldrar av den andra föräldern.
Det övergripande syftet med uppsatsen är att redogöra för hur barnets bästa är utformat i svensk rätt och hur barnets bästa har tillämpats i svensk dom- stol. I dagsläget har fler familjer än någonsin anknytning till utlandet vilket förstärker vissa problem inom familjerätten. Det övergripande syftet med uppsatsen är att redogöra för hur barnets bästa är utformat i svensk rätt och hur barnets bästa har tillämpats i svensk dom- stol. Utgångspunkten för framställningen har varit barnets bästa enligt för- äldrabalken och barnkonventionen. Frågeställningen som använts för att uppfylla syftet är huruvida barnets bästa enligt barnkonventionen tillgodoses av domstolens bedömning i vårdnadstvister med olovligt bortförande.
Uppsatsen går metodiskt igenom de olika aspekterna av barnets bästa och tittar närmre på tre rättsfall där barn blivit bortförda till utlandet av den ena föräldern. Slutligen sammanfattas uppsatsen med en analys av barnets bästa vid olovligt bortförande. (Less)

In recent years, the number of custody disputes settled in court has increased significantly in Sweden. This as a consequence of that Sweden has become a more multicultural society with increased labor migration and continuous refugee flows. Currently, more families than ever have links with foreign countries, which reinforces certain problems within family law. Several children are unlawfully abducted each year from one of their parents by the other parent.

Several children are unlawfully abducted each year from one of their parents by the other parent.
The overall purpose of this essay is to explain how the best interests of the child are designed in Swedish law and how the best interests of the child has been applied in Swedish courts. The starting point for the petition was the best interests of the child according to the Parental Code and the Convention on the Rights of the Child. The question used to fulfill the purpose is wheth- er the child's best interests according to the Convention on the Rights of the Child are met by the court's assessment in custody disputes with unlawful abduction.
The essay methodically examines the various aspects of the child's best in- terests and looks closely at three cases where children have been abducted abroad by one parent. The essay is summarized with an analysis of the best interests of the child in the case of unlawful abduction. (Less)
