Denna uppsats behandlar vårdnadsregleringen i 6 kap. föräldrabalken (1949:381), med tonvikt på principen om barnets bästa. Principen ska vara avgörande i varje beslut gällande barn enligt 6 kap. 2 a § FB. Att barnets bästa står i centrum vid bedömning har länge varit fallet i svensk rätt. Vad som är intressant med denna princip är att den är i ständig förändring då innebörden påverkas av samhällets idéer kring vad barnets bästa är samt vilka behov det individuella barnet bedöms ha. Således går det inte på ett enhetligt sätt att fastställa vad principen av barnets bästa har inneburit under den tid den tillämpats. Vad som är intressant med denna princip är att den är i ständig förändring då innebörden påverkas av samhällets idéer kring vad barnets bästa är samt vilka behov det individuella barnet bedöms ha. Således går det inte på ett enhetligt sätt att fastställa vad principen av barnets bästa har inneburit under den tid den tillämpats. Det går inte heller att på ett enhetligt sätt säga vad barnets bästa är i varje fall eftersom alla barn har olika behov. Det är istället lämnat åt rättstillämpning att fastställa i varje enskilt fall för att uppnå önskvärd flexibilitet i bedömningen.

Det blir därför relevant att undersöka hur principen tillämpats i svensk rätt. I denna uppsats genomförs därför en rättsfallsstudie av sju mål handlagda i HD under perioden 1995 – 2014. Utifrån dessa rättsfall har jag studerat om kontinuitet föreligger i rättstillämpningen gällande barnets bästa i vårdnadsmål. Genom att anlägga ett rättsutvecklingsperspektiv har dessutom innebörden av principen analyserats för att studera de eventuella förändringar som skett under nämnda period. (Less)

In this essay, the regulation of legal custody as it is written in chapter 6 in the Parental Code (1949:382) is discussed, with primary focus on the principle of the best interests of the child. According to chapter 6 paragraph 2 a in the Parental Code the principle is conclusive in every decision regarding children. This has been the case in Swedish legislation for quite some time. The content of the principle is determined by what society thinks a child could need and by what the individual needs of the child may be. This means that the content changes over time, since society changes and because every child has different needs. It is therefore impossible to determine a uniform definition of the principle. Instead, the content is established through application of law in each case to reach a desirable flexibility in judgement.

It is therefore relevant to examine how the principle has been put into practice. A study of seven cases dealt with by the Supreme Court of Sweden during the period of 1995 – 2014 has been carried out. Based on these cases I have studied, I have tried to find out if there is a continuity regarding the principle of the best interests of the child in custody cases. By adopting a perspective of development in law I have analysed the content of the principle to study potential changes during the specific period of 1995 – 2014. (Less)
