Hedersmord och hedersmotivet som en försvårande omständighet

Årligen mördas tusentals individer i hederns namn. I Sverige sker det uppskattningsvis fem hedersmord varje år och det råder även ett stor mörkertal kring hedersmord då många fall i brist på bevis rubriceras som självmord.

För att bekämpa hedersvåld och förtryck erfordras samhällsinsatser i olika former. Ett verktyg till samhällsförändring och för att bekämpa hederskulturens negativa aspekter kan vara genom särskild lagstiftning på området.

Under uppsatsens gång har grunderna för kriminalisering presenterats och utrymmet för nykriminalisering belysts. Vad som skiljer hedersmord från mord är hedersmotivet och därutav har jag undersökt gällande rätt och möjligheten till att införa hedersmotiv som en straffskärpningsgrund. Fyra... (More)

För att bekämpa hedersvåld och förtryck erfordras samhällsinsatser i olika former. Ett verktyg till samhällsförändring och för att bekämpa hederskulturens negativa aspekter kan vara genom särskild lagstiftning på området.

Under uppsatsens gång har grunderna för kriminalisering presenterats och utrymmet för nykriminalisering belysts. Vad som skiljer hedersmord från mord är hedersmotivet och därutav har jag undersökt gällande rätt och möjligheten till att införa hedersmotiv som en straffskärpningsgrund. Fyra rättsfall har studerats för att utröna om domstolarna beaktar hedersmotivet samt vilka omständigheter som har beaktats vid brottsrubricering och straffvärde.

Att införa hedersmotiv som en straffskärpningsgrund med en signalerande funktion är ur en teoretisk synvinkel möjligt. Hedersvåldet skulle uppmärksammas och synliggöras i större utsträckning, domstolarna skulle få en bredare kunskap samt större möjligheter till att upptäcka hedersrelaterade fall. Dock kan ett sådant införande medföra komplikationer kring fastställandet av definitionen då hedersbegreppet är vid och föränderlig. Även vid tillämpning skulle komplikationer uppstå, detta på grund av en eventuell risk för diskriminering av människor med utländsk bakgrund. Enligt min bedömning krävs ingen ny lagstiftning kring hedersmord då mord redan är kriminaliserad och ett införande av hedersmotiv som straffskärpningsgrund skulle strida mot principen om lika inför lagen och är således inte lämpligt. Thousands of people lose their lives in the name of the honor every year. In Sweden, there are estimated five honor killings each year. There is also a big hidden statistics when it comes to honoring killing, many cases are classified as suicide in the absence of evidence.

Social efforts are required in various forms in order to combat honor-related violence and oppression. There is a solution to combat honoring killings by legislating honor crimes specifically.

Four cases have been investigated to determine whether the courts take into account the honor motive and what circumstances that have been taken into account when it comes to classification of the crime and the penal value.

Introducing honorary motives as an aggravating circumstance in the Swedish Penal Code is possible from a theoretical point of view. The honor related violence would be highlighted and made more visible, the courts would have a broader knowledge and greater opportunities to detect honor-related cases. With such an introduction, complications regarding to the definition may arise considering that the honors term is wide and constantly changing. Problems may also occur during the application, because of a possible risk of discrimination against people with a foreign background. In my opinion, no new legislation is required for honor killing, murder is already criminalized and the introduction of honor motive as an aggravating circumstance would be contrary to the principle of equal treatment before the law and is therefore not appropriate to establish.
