Den svenska sexköpslagstiftningen är kontroversiell och har kritiserats för att sakna tydliga skyddsintressen och uppvisa bristande effektivitet. Även om lagstiftningen lett till minskad efterfrågan av sexuella tjänster i Sverige, kommer lagstiftningen inte åt de som istället köper sex utomlands i stater utan motsvarande lagstiftning. Kravet på dubbel straffbarhet hindrar lagföring i svensk domstol. Uppsatsen syftar till att, utifrån ett straffteoretiskt perspektiv, undersöka problemen med att införa ett undantag från kravet på dubbel straffbarhet för brottet köp av sexuell tjänst som begås utomlands. Den svenska sexköpslagstiftningen är kontroversiell och har kritiserats för att sakna tydliga skyddsintressen och uppvisa bristande effektivitet. Även om lagstiftningen lett till minskad efterfrågan av sexuella tjänster i Sverige, kommer lagstiftningen inte åt de som istället köper sex utomlands i stater utan motsvarande lagstiftning. Kravet på dubbel straffbarhet hindrar lagföring i svensk domstol. Uppsatsen syftar till att, utifrån ett straffteoretiskt perspektiv, undersöka problemen med att införa ett undantag från kravet på dubbel straffbarhet för brottet köp av sexuell tjänst som begås utomlands. I uppsatsen tillämpas den rättsdogmatiska samt den komparativa metoden.

I juni 2016 presenterades den utredning som bland annat fått i uppdrag att ta ställning till huruvida brottet köp av sexuell tjänst ska undantas från kravet på dubbel straffbarhet. Tillräckliga förutsättningar för ett undantag anses inte föreligga i dagsläget, främst med hänsyn till bristande internationell samsyn och svårigheter med en effektiv rättstillämpning. Förslaget har fått kritik från flera remissinstanser som anser att ett undantag hade haft en viktig normativ effekt för Sveriges ställningstagande mot köp av sexuella tjänster. I norsk rätt har ett undantag från kravet på dubbel straffbarhet införts för sexköp utomlands, vars bakomliggande motiv inte utretts inom ramen för 2016 års utredning trots att det kan få betydelse för svensk rätt. Uppsatsens utredning innehåller även en straffteoretisk del samt en redogörelse för den svenska sexköpslagstiftningens framväxt och utformning.

I uppsatsens analys konstateras att utredningens förslag är rimligt i förhållande till gällande rättsläge: något undantag från kravet på dubbel straffbarhet ska inte införas för sexköpsbrottet i dagsläget. Det är förenligt med principen om non-intervention och staters rätt till suveränitet, intressen som motiverar ett uppställt krav på dubbel straffbarhet. Därutöver anses det föreligga problem med en effektiv rättstillämpning, vilket riskerar att reducera ett undantag från dubbel straffbarhet för köp av sexuell tjänst utomlands till en symbollagstiftning utan praktiska verkningar. Slutligen framhålls att det norska undantaget från dubbel straffbarhet kan komma att spela en viktig roll för möjligheten att i svensk rätt införa ett undantag i framtiden, under förutsättning att den internationella samsynen gällande köp av sexuella tjänster ökar. The prohibition of purchase of sexual services under Swedish law is controversial and has been criticized for its lack of clear protection interests and defective efficiency. Although such legislation has reduced the demand for sexual services in Sweden, it does not apply when Swedish nationals purchase sexual services in states which do not have corresponding legislation. The double criminality requirement prevents prosecution of these people in Swedish courts. The prohibition of purchase of sexual services under Swedish law is controversial and has been criticized for its lack of clear protection interests and defective efficiency. Although such legislation has reduced the demand for sexual services in Sweden, it does not apply when Swedish nationals purchase sexual services in states which do not have corresponding legislation. The double criminality requirement prevents prosecution of these people in Swedish courts. The purpose of this essay is to analyze, from a criminal theory perspective, the problems related to the introduction of an exception to the double criminality requirement for the offence purchase of sexual services abroad. In so doing, this essay applies the legal judicial and comparative methods of analysis.

The investigation that had to decide whether the offence purchase of sexual services should be exempt from the double criminality requirement was completed in June 2016. According to this investigation, there are currently not sufficient conditions for an exception to the double criminality requirement, primarily with regard to the lack of international consensus and difficulties with effective law enforcement. This investigation has been criticized by several referral bodies which consider that an exception to the double criminality requirement would have a significant normative effect on Sweden’s position against the purchase of sexual services. In Norwegian law, an exception to this requirement has been introduced for the offence purchase of sexual services abroad. The underlying motives for this exception have not been investigated, although it may affect Swedish law. This essay also discusses criminal theory and the prohibition of purchase of sexual services in Swedish law.

From an analysis of the current legal situation, this essay argues that an exception to the double criminality requirement should not be introduced for the offence purchase of sexual services at the present time. The principles of non-intervention and State sovereignty are interests justifying a double criminality requirement. In addition, problems surrounding effective law enforcement would risk reducing an exception to the double criminality requirement to symbolic legislation with no practical effects. Finally, this essay emphasizes that the exception to the double criminality requirement in Norwegian law may play an important role in introducing an exception in Swedish law in the future, provided there is an increased international consensus regarding purchase of sexual services.
