Detta arbete undersöker processrättens roll på det migrationsrättsliga området, så som den kommer till uttryck genom ett antal migrationsprocessrättsliga särdrag. Centralt för undersökningen är hur avvägningen mellan de motstående intressena individens rättssäkerhet och processuell effektivitet har gjorts i migrationsprocessen.
Den första särdraget som behandlas är den på det migrationsrättsliga området gällande instansordningen som är en instans kortare än den instansordning som vanligtvis tillämpas inom förvaltningsprocessen. Detta arbete undersöker processrättens roll på det migrationsrättsliga området, så som den kommer till uttryck genom ett antal migrationsprocessrättsliga särdrag. Centralt för undersökningen är hur avvägningen mellan de motstående intressena individens rättssäkerhet och processuell effektivitet har gjorts i migrationsprocessen.
Den första särdraget som behandlas är den på det migrationsrättsliga området gällande instansordningen som är en instans kortare än den instansordning som vanligtvis tillämpas inom förvaltningsprocessen. Det andra särdraget som behandlas är sakens avgränsning i ett migrationsrättsligt mål. Denna avgränsning är, till skillnad från vad som gäller inom ett flertal förvaltningsrättsliga områden, mycket vid och likställs med yrkandet: uppehållstillstånd. Detta betyder att alternativa grunder för uppehållstillstånd kan prövas av domstol oavsett om Migrationsverket prövat grunderna som första instans. En sådan ordning anses motiverad med hänsyn till behovet av korta handläggningstider. Det tredje särdraget som behandlas är de processuella konsekvenser som följer på begränsningslagens införande och som innebär att den prövningsordning som gäller inom migrationsprocessen riskerar att utmanas. Det framstår efter lagändringen som mer fördelaktigt att få ett uppehållstillstånd enligt en lägre stående grund i UtlL, där permanenta uppehållstillstånd är regel, än en högre stående grund i begränsningslagen där tidsbegränsade uppehållstillstånd är regel.
Sammantaget visar de migrationsprocessrättsliga särdrag som behandlas att migrationsprocessen i förhållande till den allmänna förvaltningsprocessen tenderar att prioritera processuell effektivitet. Detta tar sig uttryck bland annat i den förkortade instansordningen och motiveringen av sakens avgränsning. Slutligen är de processuella (in)konsekvenser som följer på begränsningslagens införande också en produkt av viljan att begränsa rätten till överklagande och åtstrama möjligheten att få uppehållstillstånd i Sverige. This essay examines the role of procedural rules in the field of Swedish migration law, as this role is expressed through a number of procedural features that are special for migration law. The essay focuses on whether the procedural rules of Swedish migration law tend to prioritize the individual’s procedural safeguards or procedural efficiency.
The first unique feature of the procedural rules of migration law that is dealt with in the essay is the court hierarchy, which consists of one less instance than the court hierarchy generally applicable in Swedish administrative law. This essay examines the role of procedural rules in the field of Swedish migration law, as this role is expressed through a number of procedural features that are special for migration law. The essay focuses on whether the procedural rules of Swedish migration law tend to prioritize the individual’s procedural safeguards or procedural efficiency.
The first unique feature of the procedural rules of migration law that is dealt with in the essay is the court hierarchy, which consists of one less instance than the court hierarchy generally applicable in Swedish administrative law. The second unique feature is the delimitation of the matter at hand in a migration case. This delimitation is very wide in comparison to the delimitation generally made in administrative law, and is considered to be the same as the motion made by the appellant. Thus, the matter to be determined by the court is the right to a residence permit. This means that the court can try an alternative basis for a residence permit even if this basis has not been tried by the Migration Agency. This is motivated by the need for a short total processing time. The third unique feature is the procedural consequences following from the law restricting the right to residence permits in Sweden. These consequences mean that the order in which different bases for residence permits are tried is challenged. It is now preferable to qualify for a residence permit according to an inferior basis in UtlL, prescribing permanent residence permits, than according to a superior basis in the restriction law, prescribing temporary residence permits.
Altogether, the unique procedural features of migration law dealt with in the essay show that the procedural rules of migration law, in comparison to those of administrative law, tend to prioritize procedural efficiency. This is seen in the court hierarchy and the reasons behind the delimitation of the matter at hand. Finally, the procedural inconsistency that stems from the implementation of the restriction law is also a consequence of the wish to limit the right to appeal and restrict the possibilities to receive a residence permit in Sweden.
