Gränsöverskridande spel i Sverige och EU - Kan internets friska vindar blåsa omkull de statliga korthusen?

Den inre marknaden i EU karaktäriseras av ett antal friheter. Onlinespel faller under etableringsfrihet och friheten att tillhandahålla tjänster. Medlemsstaterna har med stöd av ett fördragsundantag, tenderat att vilja förbehålla sig rätten att erbjuda speltjänster inom respektive land. Internets framfart har dock lett till ett paradigmskifte på spelområdet där nu öppnare licenssystem ersätter monopolen. Svenska staten håller hårt i spelmonopolet för att garantera en säker konsumentmarknad, trots att utländska spelaktörer redan är stora på marknaden.

Uppsatsen söker i rättspraxis hur EU-domstolen förhåller sig till regleringar som inskränker friheten att tillhandahålla tjänster. Den svenska spellagstiftningen har blivit godkänt av EU-domstolen men det finns aspekter som är tvivelaktiga. Slutsatsen är att i brist på harmoniseringslagstiftning för speltjänster har Unionens medlemsstater för det mesta EU-rättsligt stöd för nationella handelshindrande åtgärder. (Less)

The European internal market is characterised by a number of freedoms. Online gambling is the subject of the freedom of establishment and freedom to provide services. Member states tend to invoke an exception of the free movement, granting them exclusive rights to provide gambling services. The growth of the internet and its impact on the gambling industry has however created a shift in paradigm. The gambling monopolies are replaced with more liberal regulations based on licensing. The Swedish gambling monopoly still stands tall though, because they want to ensure a safe consumer market. Even though there are numbers of large gambling companies on the Swedish gambling market.

This paper research and analyse European Court of justice gambling case law concerning national measures that are affecting cross border gambling. The Swedish regulation has been approved, but there are still some aspects that are doubtful. The lack of harmonization in the sector of online gambling in the Union has resulted in a vast acceptance of national measures that is infringing the freedom of establishment and freedom to provide services.
