- Under de senaste åren har en ny invändning vuxit fram i de svenska domstolarna i våldtäktsmål. Det kallas för sexsomni och innebär att förövaren saknar uppsåt eftersom han/hon sov under tiden för händelsen. Problematiken som har vuxit fram i domstolarna på grund av invändningen är komplex och syftet med uppsatsen har varit att undersöka den. Det finns totalt tio fall i Sverige, varav fem har lett till fällande dom och fem till friande. På grund av rättssäkerheten som ska råda i Sverige ska lika fall behandlas lika. Problematiken som har vuxit fram i domstolarna på grund av invändningen är komplex och syftet med uppsatsen har varit att undersöka den. Det finns totalt tio fall i Sverige, varav fem har lett till fällande dom och fem till friande. På grund av rättssäkerheten som ska råda i Sverige ska lika fall behandlas lika. Denna uppsats har undersökt om det finns utslagsgivande faktorer i domsluten och om det finns några brister i bedömningen. En utvidgad rättsfallsstudie med fem fall, två fällande och tre friande, har använts för att se vilka faktorer som lett fram till bedömningen.
Vad som sedermera blivit resultatet är att det inte finns några faktorer som är mer utslagsgivande än andra, varken i friande eller fällande mål. I alla mål diskuteras samma faktorer: tidigare historik av sömngångarbeteende, uppvaknandet och riskfaktorer. Trots att många av dem återfinns i alla fall finns det ingen enhetlig rättstillämpning i sexsomni-fall. Det är med hänvisning till rättssäkerhet ett oklart och prekärt rättsläge. Det torde därför utredas och uppklaras för att garantera rättssäkerheten för individen. (Less) - Abstract

- Over the course of the last couple of years a new objection has grown in the Swedish courts during rape cases. The objection is called sexsomnia and means that the perpetrator lacks intent because he/she was asleep during the time of the crime. The complex of problems that has risen in the courts due to this objection is intricate and it has been this thesis objective to investigate it. There is a total of ten cases where five has led to conviction and five to an acquittal. Because of the rule of law and the security of person similar cases should lead to similar judgements. This thesis has investigated if there are factors that are essential or conclusive in the judgement and what (if there are any) flaws exist in the judgements. Thus, the thesis has utilized a legal case study of five judgements consisting of two convicting and three acquitting to analyze what factors have led to the adjudication.
Consequently, what the thesis has found is that there are no definitive factors that determine if there is going to be a convicting or an acquittal. In all cases, including those not in the analysis of this thesis, the same factors are discussed: history of sleep-walking behavior, the awakening and risk-factors. Even though many of them apply to all cases there is no monolithic or uniform application of the law in cases of sexsomnia. Furthermore, with reference to the rule of law, it is a current legal position which is precarious and thus should be settled to ensure the security of person. (Less)
