Vittne eller brottsoffer? - En undersökning av barn som bevittnar våld i nära relationer

Barns plats i juridiken och i rättssalen är inte helt självklar. Vad gäller mäns våld mot kvinnor i nära relationer tenderar samtliga inblandade att förbise barnen. Denna uppsats avser därför att belysa hur gällande rätt reglerar barn som bevittnar våld i nära relationer och vad det får för konsekvenser för barnens skydd, i syfte att utröna om barnen bör vara brottsoffer även enligt brottsbalken.

För att kunna besvara frågeställningen har en rättsdogmatisk metod i kombination med ett barnrättsperspektiv använts. Det har framkommit att det föreligger en diskrepans i brottsoffersystematiken: barnen ses som brottsoffer enligt SoL men inte enligt BrB. Således kan de inte vara målsägande. För att kunna besvara frågeställningen har en rättsdogmatisk metod i kombination med ett barnrättsperspektiv använts. Det har framkommit att det föreligger en diskrepans i brottsoffersystematiken: barnen ses som brottsoffer enligt SoL men inte enligt BrB. Således kan de inte vara målsägande. Vidare har utvecklingspsykologiska resonemang nyanserat bilden av barnens situation. Enligt den utvecklingspsykologiska forskningen som har bedrivits på området blir barnen mycket starkt påverkade av att befinna sig i en miljö där deras mor blir slagen. De straffbud som hade kunnat aktualiseras för den som låter barnen utstå ett sådant bevittnande är ofredande och misshandel.

Om barnen hade fått målsägandestatus hade deras skydd enligt ett barnrättsperspektiv sannolikt stärkts. Sammantaget talar uppsatsens resultat i tillräckligt hög grad för att barnen bör vara brottsoffer även enligt brottsbalken. (Less)

Children’s place in the courtroom and in law in general is not evident. When it comes to domestic violence against women, the people involved in the following legal proceedings tend to overlook them. The aim of this thesis is thus to illuminate how the established law in Sweden regulates children who witness domestic violence, and the consequences for their protection thereof. The specific purpose of this thesis is to examine whether the children should be victims of crime under the Swedish Penal Code, or not.

Children’s place in the courtroom and in law in general is not evident. When it comes to domestic violence against women, the people involved in the following legal proceedings tend to overlook them. The aim of this thesis is thus to illuminate how the established law in Sweden regulates children who witness domestic violence, and the consequences for their protection thereof. The specific purpose of this thesis is to examine whether the children should be victims of crime under the Swedish Penal Code, or not.

In order to answer the research question the Swedish sources of law have been sought through. Furthermore, I have applied a children’s rights perspective on the findings. Per the findings, there is a discrepancy in the classification of victims of crime: the children are victims of crime under the Social Services Act but not under the Penal Code. This means that they are not entitled to the status of aggrieved party in the criminal legal process.

In addition, research in the field of development psychology has shed further light on the children’s situation. The research suggests that the children are very strongly affected by growing up in such an environment. The statutory regulations that could be invoked regarding the perpetrator are abuse and assault.

If the children would be granted status of aggrieved party their protection would likely be stronger. In conclusion, the findings in this thesis, with regards to the children’s rights perspective, sufficiently support the notion that the children should be victims of crime under the Penal Code.
