- Viktigt för rättssäkerheten i Sverige är att ingen ska kunna dömas oskyldig och att medborgare anklagade för brott ska betraktas som oskyldiga till dess att motsatsen bevisats. Misstag sker dock och därför finns regler kring resning i brottmål till förmån för den tilltalade i 58 kap. 2 § Rättegångsbalken (RB). Rättelse kan därmed nås genom att den dömde begär resning och på så sätt får sin dom omprövad i hopp om att den eventuellt felaktiga domen rättas till.
Det är av vikt i ett rättssäkert samhälle att en dom som vunnit laga kraft inte går att rubba lättvindigt, men viktigt är som sagt också den materiellt riktiga domen. Det är av vikt i ett rättssäkert samhälle att en dom som vunnit laga kraft inte går att rubba lättvindigt, men viktigt är som sagt också den materiellt riktiga domen. Resningsreglerna utgör en kompromiss mellan dessa två intressen; orubblighets- och sanningsprincipen. En avvägning av intressena har gjorts i förarbetena där det konstateras att sanningsprincipen bör väga tungt vid resning i brottmål till förmån för den tilltalade.
Möjlighet att beviljas resning då nya bevis eller omständigheter skapar tvivel kring domens riktighet finns därför och under vissa omständigheter räcker det att det nya materialet inte är obetydligt för att en ny prövning ska kunna göras.
I Sverige är det möjligt att söka resning obegränsat antal gånger så länge något nytt kan tillföras. Hur bedömningen ska gå till då är inte lagstadgat utan hur rätten ska gå till väga är något HD fastslagit i praxis. Där konstateras att material som bedömts av HD vid en resningsansökan inte ska bedömas igen vid en eventuell ny ansökan. Då prövas endast det nya materialet som tillkommit och tidigare bedömningar låses alltså fast.
I fallet Kalamarksmordet följer domstolen praxis när reglerna tillämpas och resning beviljas först vid den tredje ansökan, vilket tyder på att regleringen inte är tillfredsställande för den tilltalade ur ett rättssäkerhetsperspektiv. I förarbetena konstateras att inga bevis bör bedömas isolerat, men HD:s praxis leder till att det blir oundvikligt. Låser man in bedömningar som gjorts skapas en stelhet i regleringen som gör att sanningsprincipen tappar tyngd och därför kan det vara läge att se över resningsreglerna och hur de tillämpas. - It is of importance that citizen’s accused of crime is seen as innocent until proven guilty and no one should be innocently convicted. But mistakes happen and therefor there are rules for granting convicted citizens a new trial in 58 kap. 2 § Rättegångsbalken (RB).

It is essential in a legal certain society that a verdict which has gained legal force is not easily removed, but as previously mentioned, the verdict true to the evidence is essential. The legislation regarding petitioning for new trial makes a compromise between the principle of steadfastness and the principle of truth. When creating the law it has been decided which principle should be of bigger importance and when it comes to the rules regarding the convicted being granted a new trial it is decided the truth should weigh heavily.
The possibility to be granted a new trial exists therefor when there is newly discovered evidence that can create a doubt about the correctness of the verdict. During some circumstances it is enough that the new material is not insignificant in order to be granted a new trial.
In Sweden it is possible to seek petition for a new trial unlimited number of times as long as something new to add is found. It is not regulated in the law how the assessment of evidence should be handled in these cases. It is something that the Supreme Court has established in praxis. The Court has established that the material that already has been reviewed by the court in a petition not should be reviewed again in a new petition. The Court should only look at the new material in the new petition and former assessments are “locked in”.
In the case “Kalamarksmordet” the Courts follows these rules set by it self and a new trial is granted first after the third petition. This indicates that the regulation not is satisfactory for the citizens being wrongfully convicted of crimes. When the law was created it was decided that the material in the case not should be reviewed isolated, but the new rules set by the Supreme Court makes that impossible. If assessments are locked in like this it creates stiffness in the regulation that makes the truth seem less important. Therefor it might be time to overlook the law of how to be granted a new trial and how the law is applied. (Less)
