Systembolaget AB har idag monopol på detaljhandeln av alkoholen i Sverige sedan ungefär 60 år tillbaka. Alkoholen har givits en särställning på den annars öppna marknaden på grund av samhällsintresset att hålla ned alkoholkonsumtionen.

Syftet med denna uppsats var att genomlysa det svenska alkoholmonopolets reglering och dess bakomliggande intressen. Regleringen omfattar både svensk rätt och EU-rätt eftersom Sverige sedan år 1995 är medlemmar i EU.

För uppgiften studerades främst de traditionella juridiska källorna så som lagstiftning och förarbeten.

Undersökningen visade att det främst motivet bakom monopolet är att det ska begränsa tillgängligheten till alkohol och därmed begränsa alkoholkonsumtionen. Monopolet verkar också... (More)

Monopolet verkar också ha en begränsande inverkan på tillgängligheten. Inom EU råder fri rörlighet för varor. Vad undersökningen vidare visade var att åtgärder som begränsar den fria rörligheten inom EU, så som alkoholmonopolet, inte får vara mer långtgående än nödvändigt.

Slutsatsen som kunde dras utifrån undersökningen var att monopolet fyller en funktion i samhället i och med att de förser befolkningen alkohol samtidigt som det begränsar tillgängligheten och därmed skadeverkningarna av alkoholen. Andra åtgärder som är mindre långtgående kan dock tillgodose samma ändamål och därför finns inte stöd i EU-rätten för att bevara monopolet. (Less)

Currently Systembolaget AB has a monopoly on the retail of alcohol in Sweden since about 60 years. Alcohol has been given a special position on the otherwise open market because of the societal interest in keeping the alcohol consumption down.

The purpose of this paper was to examine the Swedish regulation on the monopoly and its underlying interests. The regulation covers both Swedish law and EU law since Sweden has been a member of th EU since 1995.

The task was primarily accomplished with the traditional legal sources such as legislation and legislative work.

Currently Systembolaget AB has a monopoly on the retail of alcohol in Sweden since about 60 years. Alcohol has been given a special position on the otherwise open market because of the societal interest in keeping the alcohol consumption down.

The purpose of this paper was to examine the Swedish regulation on the monopoly and its underlying interests. The regulation covers both Swedish law and EU law since Sweden has been a member of th EU since 1995.

The task was primarily accomplished with the traditional legal sources such as legislation and legislative work.

The investigation showed that the main reason behind the monopoly is that it limit the access to alcohol and thus limit alcohol consumption. The monopoly also seems to have a limiting impact on accessibility. But, within the EU there is free movement of goods. What the investigation further showed was that measures restricting the free movement within the EU, such as the alcohol monopoly, should not be more far-reaching than necessary.

The conclusion that could be drawn from the investigation was that the monopoly has its function as they provide the population with alcohol while limiting availability and thus the negative effects of alcohol. However, other measures that are less far-reaching can meet the same purpose, and therefore the alcoholmonopoly should be abolished because it is not in accordande with the EU law. (Less)
