Uppsatsen behandlar Ombudsmannen mot Etnisk Diskriminering och
Diskrimineringsombudsmannens bedömningskriterier vid handläggning av
diskrimineringsärenden som berör etnisk diskriminering. Ombudsmännens bedömningar
jämförs med Arbetsdomstolens beslut i 17 rättsfall som berör etnisk diskriminering. Syftet är
att analysera om det finns en skillnad mellan ombudsmännens bedömningar och
Arbetsdomstolens beslut samt hur de i så fall skiljer sig. Vi argumenterar och diskuterar även
slutsatser som kan dras utifrån resultatet.

jämförs med Arbetsdomstolens beslut i 17 rättsfall som berör etnisk diskriminering. Syftet är

etnisk diskriminering. Jämförelsen riktar in sig på den lagstadgade bevislättnaden samt hur
rekvisiten enligt diskrimineringslagen tolkats i rättsfallen.
I vår slutsats fann vi att det fanns stora skillnader på vilka kriterier ombudsmännen och
domstolen värderar vid utredning av rättsfall. Särskilt skiljer sig ombudsmännens
bedömningar från Arbetsdomstolens gällande uppfyllda rekvisit, där Ombudsmannen mot
etnisk diskriminering och Diskrimineringsombudsmannen sällan tillräckligt kunnat styrka att
direkt eller indirekt diskriminering förelegat. Bedömningarna har skilt sig främst vid tolkning
av jämförbar situation och missgynnandets samband med diskrimineringsgrund. De här
skillnaderna beror delvis på deras varierande syften och därmed arbetsprocesser såväl som
rollen de antar i domstolen. Den lagstadgade bevislättnaden har haft stor påverkan på
diskrimineringsfallen. Bevislättnaden har många gånger varit en avgörande faktor vid
uppfyllandet av ett rekvisit och som försvårat ombudsmännens möjligheter att få sina
yrkanden bifallna. (Less)

The essay discusses the Ombudsman against Ethnic Discrimination and Discrimination
Ombudsman’s criteria of assessment when processing reported discrimination cases
concerning ethnic discrimination. The Ombudsmen’s criteria of assessment are compared
with the Swedish Labour Court’s decisions in 17 cases concerning ethnic discrimination. The
purpose is to analyse if there is a difference between the Ombudsmen’s criteria of assessment
and the Labour Court’s decisions, and if that is the case, on what matters they differ. We also

The essay discusses the Ombudsman against Ethnic Discrimination and Discrimination
Ombudsman’s criteria of assessment when processing reported discrimination cases

evidence and how prerequisites for discrimination are interpreted in the court cases.
In our conclusion we found large differences regarding what criterias the Ombudsmen and
the Labour Court evaluates during case investigations. The Ombudsmen’s criteria of
assessment particularly differ from the Labour Court’s regarding fulfilled prerequisites for
discrimination, whereas the Ombudsman against Ethnic Discrimination and Discrimination
Ombudsman seldom are able to prove direct or indirect discrimination to be likely. The
criteria of assessment differ primarily when interpreting comparable situation and the
mistreatment’s correlation with a ground for discrimination. These differences partly derives
from their differing purposes and thus varied processes as well as the role the parties assume
in court. The statutory relief of evidence have had a major impact on the discrimination cases.
The relief of evidence have many times been a decisive factor on the fulfillment of the
prerequisites for discrimination, which has hampered the Ombudsmen’s ability to have their
claims ruled in their favour. (Less)
