- Om en arbetstagares alkoholbruk går ut över arbetsprestationen så ligger det i arbetsgivarens intresse att åtgärda det, antingen genom att se till att arbetstagarens arbetsprestation blir bättre igen eller genom att avbryta anställningen. I svensk arbetsrättslagstiftning är det dock viktigt att särskilja på om en arbetstagare isåfall lider av en alkoholsjukdom eller inte. Om det inte föreligger en sjukdom så kan alkohol i samband med arbetslivet kopplas som misskötsel, och hanteras utifrån principerna kring misskötsel. Är arbetstagaren däremot alkoholsjuk så så gäller ett stärkt anställningsskydd, då sjukdom generellt inte får ses som en saklig grund för uppsägning. Genom att anpassa arbetsplatsen utifrån arbetstagarens behov eller omplacera arbetstagaren kan arbetsgivaren sikta på att uppfylla de krav som ställs på henom och i princip göra allt som hen kan, inom en rimlig gräns, för att se till att arbetstagaren fullt kan återgå till sitt arbete. Har inte arbetsgivaren vidtagit rätt åtgärder som ses också en uppsägning som inte sakligt grundad. Det är först när en arbetstagare har en stadigvarande nedsättning och inte längre kan utföra arbete av betydelse som en uppsägning kan vara aktuell. (Less)

- When an employee’s alcohol habits affect their work, then it is in the employers interest to resolve the problem, either by helping the employee get better or by ending the employment. In swedish labour law, it is however important to distinguish cases between where an employee just abuses alcohol, and cases where an employee is suffering from an alcohol-related disease. If the employee isn’t sick, then the alcohol abuse connected to the employment can be seen as neglect from the employee, and will be seen as neglect from a legal point of view. However, if the employee is suffering from an alcohol-related disease, then their employment protection will also be increased, since a disease generally never is a valid reason to terminate an... - When an employee’s alcohol habits affect their work, then it is in the employers interest to resolve the problem, either by helping the employee get better or by ending the employment. In swedish labour law, it is however important to distinguish cases between where an employee just abuses alcohol, and cases where an employee is suffering from an alcohol-related disease. If the employee isn’t sick, then the alcohol abuse connected to the employment can be seen as neglect from the employee, and will be seen as neglect from a legal point of view. However, if the employee is suffering from an alcohol-related disease, then their employment protection will also be increased, since a disease generally never is a valid reason to terminate an employment contract. In these cases, the employer has a duty to rehabilitate the employee, based on the rules laid out in AML and SFB. By taking measures based on the employees needs like redeployment or adapting the workplace, the employer can work towards fulfilling the rehabilitation requirements and constantly work towards getting the employee back into his/her original employment. If an employer hasn’t fulfilled his/her rehabilitation requirement, then a termination can not be seen as objectively grounded. A termination connected to the alcohol abuse can first be seen objective when the employee no longer can carry out work of importance. (Less)
