- Abstract
- The purpose of this essay is to examine to what extent a state really is bound to signed treaties and international customary law. Treaties are in their foundation a contract and it happens that contracts are broken. Questions which the essay aim to answer are which possibilities there are for a state to receive restitution for wrongful acts and what can an international court or arbitration do to enforce decisions and judgments and make sure they are in fact applied? The thesis for this undertaking is thus if all states have the same legal position in relation to international justice and do all states possess the same possibility to receive restitution from erroneous states? - The purpose of this essay is to examine to what extent a state really is bound to signed treaties and international customary law. Questions which the essay aim to answer are which possibilities there are for a state to receive restitution for wrongful acts and what can an international court or arbitration do to enforce decisions and judgments and make sure they are in fact applied? The research has as far as it is possible been done through primary sources such as treaty text and court cases, but also to large extent through secondary sources such as doctrine. The doctrine is mainly from various professors in international law. The essay also aims to analyze and discuss the questions through liberal legal theory and Marxism to get a more balanced and nuanced image of the results. Conclusions that are reached are that states in theory are equal, but that reality does not always reflect that, which also affects states possibilities to receive restitution or compensation when treaties are broken, or their sovereignty is violated. - Syftet med denna uppsats är att undersöka till vilken utsträckning en stat egentligen är bunden till påskrivna traktater och den internationella sedvanerätten. Traktater i grund och botten avtal och det händer att avtal bryts. Frågor som uppsatsen siktar på att svara är vilka möjligheter finns det för en stat att få upprättelse för felaktiga handlingar och vad kan en internationell domstol eller skiljedomstol göra för att genomdriva beslut och domar och se till att det faktiskt tillämpas? Frågeställningen för detta arbete är således ifall alla stater har samma rättsliga ställning i förhållande till internationell rättskipning och har alla stater samma möjlighet till att få upprättelse från felande stater? - Syftet med denna uppsats är att undersöka till vilken utsträckning en stat egentligen är bunden till påskrivna traktater och den internationella sedvanerätten. Frågeställningen för detta arbete är således ifall alla stater har samma rättsliga ställning i förhållande till internationell rättskipning och har alla stater samma möjlighet till att få upprättelse från felande stater? Forskningen har skett i största möjliga mån genom primära källor som traktaktstext och rättsfall, men även i stor utsträckning genom sekundära källor som doktrin. Doktrinen är i huvudsak från diverse professorer i folkrätt. Uppsatsen syftar också att analysera och diskutera frågorna med hjälp av liberal rättsteori och marxism för att få en mer balanserad och nyanserad bild av resultatet. Slutsatser som nås är att stater i teorin är likställda men att verkligheten inte alltid återspeglar det vilket också påverkar staters möjlighet att få upprättelse eller gottgörelse när traktater bryts eller suveränitet kränks.
