I mål B554-15 från Borås tingsrätt och mål B3118-16 från Hovrätten för Västra Sverige var en i domstolen könad man åtalad för att ha våldtagit en i domstolen könad kvinna. Den tilltalade påstods ha genomfört sexuella handlingar genom att otillbörligt ha utnyttjat att målsäganden befunnit sig i en särskilt utsatt situation. Den tilltalade fälldes för våldtäkt i tingsrätten. I hovrätten friades han eftersom han trodde att målsäganden sov när hon i själva verket var drabbad av allvarlig rädsla då handlingarna utfördes.

Den tilltalade påstods ha genomfört sexuella handlingar genom att otillbörligt ha utnyttjat att målsäganden befunnit sig i en särskilt utsatt situation. Den tilltalade fälldes för våldtäkt i tingsrätten. I hovrätten friades han eftersom han trodde att målsäganden sov när hon i själva verket var drabbad av allvarlig rädsla då handlingarna utfördes.

Att utföra sexuella handlingar på en person medan hen sover respektive är drabbad av allvarlig rädsla utgör våldtäkt enligt 6:1 2 st BrB då båda tillstånden kan utgöra en särskilt utsatt situation. Enligt täckningsprincipen ska gärningspersonens föreställda händelseförlopp i tillräcklig grad korrespondera med det verkliga händelseförloppet så långt detta är bevisat i processen för att uppsåtet ska vara täckt. Det finns ingen uttrycklig reglering av kravet på uppsåt vid situationer som den i fallet. Vidare finns det inte heller något prejudicerande avgörande på området, eller vetenskapliga studier som behandlar rättsfallet. Den här uppsatsen syftar till att undersöka hur tingsrättens samt hovrättens domskäl förhåller sig till gällande rätt samt genusrättsvetenskapliga teorier om sexuellt våld.

Uppsatsen visar att de granskade domskälen kan ifrågasättas i förhållande till förarbeten och den straffrättsliga doktrinen. Det finns i dessa rättskällor stöd för att kravet på täckning är uppfyllt i de fall det rör sig om alternativa brottsrekvisit, även om gärningspersonens uppsåt skulle hänföra sig till ett annat brottsrekvisit än det som faktiskt har uppfyllts. Vidare konstaterar uppsatsen att domskälen bekräftar en stor del av genusrättsvetenskapliga teorier om sexuellt våld. (Less)

In case B554-15 from Borås District Court and case B3118-16 from Court of Appeal for Western Sweden, a gendered man was impeached for having raped a gendered woman. The accused was charged with having performed sexual acts on the complainant, improperly exploiting the fact that she was in a particularly vulnerable situation. The accused was convicted by Borås tingsrätt for having raped the complainant. However, the Court of Appeal for Western Sweden reversed the decision and acquitted the accused, referring to the fact that he had thought she was sleeping while she was actually stricken with grave fear.

Performing sexual acts on a person who is either sleeping, or stricken with grave fear are both considered to constitute rape... (More)

Performing sexual acts on a person who is either sleeping, or stricken with grave fear are both considered to constitute rape according to Swedish penal law, since both of the states are considered to constitute a particularly vulnerable situation for the victim. Under Swedish penal law, the course of events according to perpetrator’s envision is supposed to correspond with the actual course of events as far as they are proven in the process, for the court to be able to convict the accused for having committed a crime. There is no explicit Swedish regulation, nor any Swedish judicial precedent which establishes a requirement of intent in cases like the one described above. Moreover, the are no studies to be found of this case. The objective of this thesis is to examine how the grounds of the two courts’ judgments can be understood in relation to established law as well as feminist legal theories of sexual violence.

This thesis shows that the examined grounds of the judgments can be questioned on the basis of legislative history and doctrine within Swedish penal law. Within these sources of law there is endorsement for the crime’s objective prerequisites to be considered to be covered by the perpetrator’s intent in cases with alternative prerequisites. This is so even though the accused’s intent covers another prerequisite than the one that de facto has been fulfilled. In addition, the thesis shows that the grounds of judgment confirm the feminist legal theories on sexual violence presented herein. (Less)
