Gradindelning och straffvärdebedömning vid grövre narkotikabrott - Ett belysande av utvecklingen i svensk rätt

Denna uppsats belyser den utveckling som skett i svensk rätt av hur gradindelning och straffvärdebedömning vid grövre narkotikabrott. I samband därmed analyseras de konsekvenser som NJA 2011 s. 357 (Mefedrondomen) och den nya brottsrubriceringen synnerligen grovt narkotikabrott fått.

Trots att både gradindelning och straffvärdebedömning vid grövre narkotikabrott ska utgå från fler omständigheter än sort och mängd narkotika har i rättstillämpningen fram till 2011, nästintill endast beaktats sort och mängd av narkotika utifrån de riktlinjer som återfanns i tabeller. Trots att både gradindelning och straffvärdebedömning vid grövre narkotikabrott ska utgå från fler omständigheter än sort och mängd narkotika har i rättstillämpningen fram till 2011, nästintill endast beaktats sort och mängd av narkotika utifrån de riktlinjer som återfanns i tabeller. Med utgångspunkt i NJA 2011 s. 357 (Mefedrondomen) och ett antal prejudicerande domar därefter, lade HD grunden för en praxisändring. I den domen ifrågasatte HD den gradindelning och straffvärdebedömning som utvecklats i domstolarna och som utgick från sort och mängd med användandet avoch som fastställdes genom tabeller. En konsekvens av detta var att alla relevanta omständigheter skulle numera få ett betydande genomslag både vid gradindelning och straffvärdebedömning. Praxisändringen föranledde att straffnivåerna för de grövre narkotikabrotten sänktes. Denna rättsutveckling fick lagstiftaren att reagera och 2016 delades straffskalan för grovt narkotikabrott upp och brottsrubriceringen synnerligen grovt narkotikabrott infördes. Avsikten med införandet av brottsrubriceringen synnerligen grovt narkotikabrott var att återigen skärpa straffen för särskilt stora mängder narkotika.

Undersökningens slutsats är att den senaste utvecklingen inneburit att sort och mängd narkotika återigen fått mer betydelse vid gradindelning och straffvärdebedömning men inte det betydande genomslag som lagstiftaren hade för avsikt med införandet av brottsrubriceringen synnerligen grovt narkotikabrott. Abstract
This thesis describes the development that has taken place in Swedish law regarding the classification of a crime and the assessment of penal value, concerning grave narcotic offences. In connection with this the consequences of the Supreme Court’s ruling NJA 2011 s. 357 and the new crime classification “exceptional grave narcotic offence” will be analysed.

Despite that the classification of the crime and the assessment of penal value regarding grave narcotic offences shall be based on more circumstances than the type and amount of narcotics, the established practice until 2011 has been that the type and amount of narcotics was the only circumstance considered. This thesis describes the development that has taken place in Swedish law regarding the classification of a crime and the assessment of penal value, concerning grave narcotic offences. In connection with this the consequences of the Supreme Court’s ruling NJA 2011 s. 357 and the new crime classification “exceptional grave narcotic offence” will be analysed.

Despite that the classification of the crime and the assessment of penal value regarding grave narcotic offences shall be based on more circumstances than the type and amount of narcotics, the established practice until 2011 has been that the type and amount of narcotics was the only circumstance considered. These were based on guidelines found in charts. In the ruling NJA 2011 s. 357 and in a number of subsequent prejudicial judgements, the Supreme Court laid the foundation for a change in case law. The Supreme Court questioned the classification and the assessment of penal value concerning grave narcotic offences based on only the type and amount of narcotics. A consequence of this change in case law was that all relevant circumstances should have a significant impact both on the classification of the crime and the assessment of penal value concerning grave narcotic offences. The change in case law made the penalties lower for grave narcotic offences. This development got the legislator to react and during 2016 the legislator introduced a new crime classification, exceptional grave narcotic offence. The purpose of the introduction of the new classification, exceptional grave narcotic offence, was to once again raise the penalty for especially large amounts of narcotics.

The thesis conclusion of the latest development is that the amount of narcotics once again has gained more impact on the classification of the crime and the assessment of penal value, regarding grave narcotic offences. However not the significant impact the legislator intended when they introduced the new classification “exceptional grave narcotic offence”. (Less)
